It revised all the bookmarks of Yokohama-shi road position designated application on April 20, 2020 and changed to "guide of Yokohama-shi road position designated application".

Revised contents of 2019

It revised partly on June 14, 2019.
With some revisions of Yokohama-shi Building Standard Act detailed enforcement regulations, in the case of designated application of position of road, it revised way of "designated figure (No. 8 style) of position of road" which submission needed. As a general rule, about road to appoint after June 14, 2019, it is necessary to use new style, but, about thing which has been already made with old style, can just use for the duration.

It revised partly on September 25, 2018.
As consent of manager was necessary when we received designation of road with revision of Building Standard Act, we performed revision with this. In addition, it revised indispensability accompanied with law revision.

Summary

Site of building must contact with "road" corresponding to definition of road of Building Standard Act (law No. 201 is called "law" as follows in 1950.) Article 42. (law Article 43 Paragraph 1)
As one of the things recognized as the road, it is prescribed with "thing that person who is going to construct this on way adapting to road law, the Town Planning and Zoning Act, the land adjustment method, the Urban Redevelopment Law, new urban infrastructure maintenance method or standard to set by house in big city area and cabinet ordinance to construct without depending on special measures law about promotion of supply of residential area to use land as site of building received designation of the position from identification administrative agency" in law Article 42 Paragraph 1 No. 5.
This does in "we appoint of position of road".
In addition, permission of residential land development is necessary in addition when the land is accompanied by creation in regulation areas of the regulation method such as residential land development. In addition, we receive designation of position of road, and the area of the area that can plan use of land is limited to 500m2 within land that development permission of the Town Planning and Zoning Act is not for.

Agreements such as rightful claimants concerned

  • Significance
    It will be imposed on limit of serious right in private land without constructing buildings in character as road when it is with the road concerned floor, and there is when we receive designation of position of road (law Article 44 and law Article 45).
    Therefore, in designated application of position of road, "building in owner of site of road which is going to catch designation and land that it is and the land or the land or written consent of person having right about workpiece and person who manages to adapt to standard to prescribe in 4 Paragraph 1 of Article 144 to give an order to start the way concerned and Paragraph 2" is necessary.
  • Ranges such as rightful claimants needing written consent concerned
    • Rightful claimant of land becoming site of road which is going to catch designation and manager of the land concerned.
    • Person (including provisional registration rightful claimant) that range of right has rights such as proprietary rights, superficies, the loan right, mortgage, permanent tenant rights, servitude, right of pledge, preferential right.
  • Rightful claimant judges by the items mentioned of the former ward (proprietary rights) of land register certified copy and the second ward (right except proprietary rights).
  • It is said, and owner of the land concerned considers person who manages land becoming site of road where manager is going to receive designation and evacuation passage to adapt to standard when we received designation to be manager. When there is manager as well as owner of land, consent is necessary from the manager concerned.
  • Seal Registration Certificate 
    • Please attach Seal Registration Certificate by all means to confirm that it is seal of genuine rightful claimant or manager.
  • Expiration date such as each certificate 
    • Register certified copy, proof documents, please attach thing latest as possible to prevent from leaving problem later about having consent or not such as rightful claimants concerned.
    • About register certified copy, it should be thing within three months after application about Seal Registration Certificate after application for less than one month.

We unify attached books to size of A4 version, and the left spelling, please. (drawings tuck in)
As a general rule, applicant is owner of land becoming road.
"Designated written consent of position of road" needs consent of all rightful claimants of land becoming road. Please attach seal and Seal Registration Certificate of registered seal of all the members.
Range of rightful claimant "4 please judge by land register certified copy (as for copying, impossible) and public sectional map based on agreement of rightful claimant".
Designated figure of road position attaches for each one copy of blueprint to application (plus vice-), and you bag one copy of original drawing (mino paper) and one copy of blueprint, and please attach to application (plus).
