Revision history

Revisions for FY2022

We revised a part of "guide of Yokohama-shi road position designation application" on September 1, 2022.
Posting of "(Reference) Basic way of thinking of road position designation on waterway site", revision of "designation consent form of road position (No. 9 style)" and necessary revisions accompanying optimization of other procedures going. In addition, about thing which is made in old style, it is possible to modify and use for the time being.

Revisions for FY2021

We revised a part of "guide of Yokohama-shi road position designation application" on April 1, 2021.
We revised style of "designation application (seventh style) of position of road", "road abolition (change) application (No. 10 style)" and "application for designation prior examination of position of road". In addition, about thing made in old style, we can use as it is for the time being.

Revisions for FY2020

We revised all bookmarks of Yokohama-shi road position designation application on April 20, 2020 and changed to "guide of Yokohama-shi road position designation application".

Revisions for FY2019

It was partially revised on June 14, 2019.
With partial revision of Yokohama-shi Building Standard Act enforcement detailed regulations, we revised style of "designation figure (the eighth style) of position of road" which presentation was necessary at the time of designation application of position of road. About road to appoint after June 14, 2019, it is necessary to use new style in principle, but, about thing which is already made in old style, can be used as it is for the time being .

Revisions for FY2018

It was partially revised on September 25, 2018.
With the revision of the Building Standards Law, when receiving the designation of a road, the consent of the manager was required, so we revised it accordingly. In addition, necessary revisions have been made in accordance with the revision of the law.

Revisions for FY2013

Overview

The site of the building must be in contact with the "road" corresponding to the definition of the road in Article 42 of the Building Standards Act (Act No. 201 of 1950, hereinafter referred to as the "law"). (Article 43, Paragraph 1 of the Act)
As one of the recognized roads, Article 42, Paragraph 1, Item 5 of the Act states, "To use land as a site of a building, the Road Law, the City Planning Law, the Land Readjustment Law, the Urban Redevelopment Law, the New Urban Infrastructure Development Law, or the Special Measures Law Concerning the Promotion of Supply of Housing and Residential Areas in metropolitan areas, a road that conforms to the standards specified by a Cabinet Order specified by a Cabinet Order, and a Cabinet Order that is to the specified by a Cabinet Order built without complying to the specified by a Cabinet Order concerning the Act on the Act on Promotion of Housing and the Act on the Act on the Act on Promotion of Housing and the Act on Promotion of Housing and Residential Area.

Consent of related right holders

  • Significance
    If the location of the road is designated, it is not possible to build buildings, etc. on the roadbed due to the nature of the road (Article 44 of the Act and Article 45 of the Act), and serious rights on private land Will be imposed.
    Therefore, when applying for the designation of the location of the road, "The owner of the land that will be the site of the road to be designated and the person who has the right to the building or structure on the land, and the road concerned A written consent of the person who manages to conform to the standards prescribed in Article 144-4, Paragraph 1 and Paragraph 2 of the Ordinance "is required.
  • Scope of related right holders, etc. who require written consent
    • The right holder of the land that will be the site of the road to be designated.
    • The scope of the right is a person who has the right of ownership, ground right, lease right, mortgage, tenant right, landowner, pledge, preemptive privilege, etc. (including temporary registration right holder).
  • If there are structures (bridges, etc.) on the land that will be the site of the road to be designated, a written consent is also required from the right holders of the structures.
  • The right holder is determined based on the items described in the A-ku (ownership) and Otsu-ku (rights other than ownership) of the certified copy of the land registry.
  • The manager refers to a person who manages the land that will be the site of the road to be designated and the evacuation passage to conform to the standards at the time of receiving the designation. In principle, the owner of the land is considered to be the manager of the road, etc., but if the manager is different from the owner of the land or if there is another manager, enter that effect in the written consent form And consent is required from the manager.
  • Seal Registration Certificate, etc. 
    • Please be sure to attach the Seal Registration Certificate to confirm that you are the genuine right holder or administrator seal.
  • The expiration date of each certificate, etc. 
    • Regarding the consent of the relevant right holders, etc., please attach the latest copy of the registry, certificates, etc. as much as possible to prevent leaving a problem later.
    • In principle, a copy ofSeal Registration Certificate must be made within one month from the time of application.

Books required for preliminary examination are as follows. (The number of copies submitted is "positive" and "vice (possible copy)" 2 copies)

  1. Request for prior examination of the position of the road (depending on the attached style)
  2. Power of Attorney (if requested by proxy/agent)
  3. Attached drawings (as shown in Table 1)
  4. Copy of land registry (original)

Procedures for preparing documents and drawings

Attached books should be unified to the size of A4 size and left spelled. (Drawings, etc.)
The applicant is, in principle, the owner of the land that will become the road.
The "Consent Form for Designation of Road Location" requires the consent of all right holders of the land that will be the road. Please attach everyone's seal and Seal Registration Certificate from registered seal.
The scope of the right holder should be determined based on a copy of the land registry (copy is not allowed) and official map based on "4. Consent of the right holder".
For the designated map of the road position, bind one copy of each blue porcelain in the application form (primary and secondary), and put one copy of the original drawing (Mino paper) and one copy of the blue porcelain in a bag and attach it to the application form (correct). .
