Permission for buildings in restricted zones (Article 48 of the Building Standards Act)

Notice

We revised and formulated permission standards based on the provisions of Article 48 of the Building Standards Law. (May 24, 2024)

・Permission standards based on the provisions of Article 48 of the Building Standards Law pertaining to stores whose main purpose is to sell daily necessities in the first-class low-rise residential area and second-class low-rise residential areas

・Permission standards based on the provisions of Article 48 of the Building Standards Law pertaining to cafeterias, coffee shops, service stores, etc. in the first-class low-rise residential area

・Permission standards based on the provisions of Article 48 of the Building Standards Law pertaining to offices in the first-class low-rise residential area and the second-class low-rise residential area

Outline of the System

According to the proviso of each paragraph of Article 48, Paragraphs 1 to 14 of the Building Standards Act, public hearings only when it is deemed that there is no risk of harming the environment intended by the restricted area or when it is deemed unavoidable in the public interest. By holding a meeting and obtaining permission from the Building Examination Committee, it may be possible to build a use prohibited by usage regulations.


In order to provide appropriate guidance based on the technical advice of the government, etc., “stores whose main purpose is to sell daily necessities”, “canteens or coffee shops, service stores, etc.”, “offices”, “automobile repair shops” and “existing dry cleaning factories”, we have established permission standards.

How to submit and receive each document
