Permission for buildings in restricted zones (Article 48 of the Building Standards Law)

Notice

We revised and formulated permission standards based on the provisions of Article 48 of the Building Standards Law. (As of May 24, 2024)

・Permission criteria based on the provisions of Article 48 of the Building Standards Law pertaining to stores whose main purpose is to sell daily necessities in the first-class low-rise residential area and the second-class low-rise residential area

・Permission criteria based on the provisions of Article 48 of the Building Standards Law pertaining to cafeterias, coffee shops, service stores, etc. in the first-class low-rise residential area

・Permission criteria based on the provisions of Article 48 of the Building Standards Law pertaining to offices in the first-class low-rise residential area and the second-class low-rise residential area

Overview of the System

Public hearings only when it is deemed that there is no risk of harming the intended environment of the restricted zone or when it is deemed unavoidable in the public interest according to the proviso of each paragraph of Article 48, paragraphs 1 to 14 of the Building Standards Act, It may be possible to build a use prohibited by use regulations by holding a hearing and obtaining permission after obtaining the consent of the Building Examination Committee.


In order to provide appropriate guidance based on the technical advice of the country, "stores whose main purpose is to sell daily necessities", "canteens or coffee shops, service stores, etc.", "offices", "automobile repair shops" and "existing dry cleaning factories" have established permission standards.
