On June 1, 2016, the "Act on Partial Revision of the Act on Promotion of Specified Non-Profit Activities" (Law No. 70 of 2016) was enacted and promulgated on June 7, 2016. Was.
This Amendment Law will come into effect on April 1, 2017.
※However, some will be enforced from the date specified by a Cabinet Order within a period not exceeding two years and six months from the date of promulgation.

Details of the revision of the NPO Law

In the "Guide to the Act on the Promotion of Specified Non-Profit Activities" (Materials prepared by the Cabinet Office), you will find out the points of the revised content. Please refer to the following points in particular.

  • The retention period for business reports has been extended to five years. Please respond to business reports, etc. for the fiscal year beginning after April 2017.
  • In order to further improve the reliability of NPO corporations, the Cabinet Office NPO portal site has been established. This portal site allows corporations to post activity information and financial information on their own, and can also be used from smartphones, etc., so please use it actively.   • Regarding officer remuneration regulations of certified and designated NPO corporations, the retention period has been extended to five years. Please respond from the fiscal year beginning after April 2017.
  • Some formats will be changed due to a change in name from a provisionally certified non-profit organization to a specially certified non-profit organization or a revision of the rules for overseas transfer.
  • Of the NPO corporations designated by Yokohama City, NPO corporations that have also been certified do not need to submit documents with duplicate contents in the officer remuneration regulations (annual report) that required to be submitted for each certification designation Ordinance has been revised.

Amendments to the Articles of Incorporation

NPO corporations were obliged to change the registration of the total amount of assets every year at the Legal Affairs Bureau based on the registration order of unions, etc., but instead of eliminating the need to register the change, publish the balance sheet every year. Is required. (Scheduled to take effect on October 1, 2018 *) ※The reason "planned" is that the enforcement date of the public notice of the balance sheet is set to be the date specified by a Cabinet Order within two years and six months from the date of promulgation of the revised NPO Law.

The method of publicizing the balance sheet must be stipulated in the Articles of Incorporation by October 1, 2018, so please make a decision to amend the articles of incorporation at the general meeting in 2017 or 2018 and make the necessary/required procedures Please.
