Yokohama City Ordinance (Landscape Ordinance) on Creation of Attractive Urban Landscape

1. Purpose of Amendment

From the perspective of protecting the lives and bodies of the people from disasters caused by embankments, etc., the Act on Partial Revision of the Residential Land Development Act was promulgated on May 27, 2022, which comprehensively regulates dangerous embankments, etc. based on uniform standards nationwide, regardless of the use or purpose of the land where embankment is performed. Along with this, we changed some of the provisions pertaining to the "Regulation Law for Residential Land Development" in the Landscape Ordinance.

The Landscape Ordinance stipulates that those who perform "cityscape formation act" in the consultation district must consult with Yokohama City in advance, but some other laws and regulations before the development and change of the consultation district It is stipulated that this rule does not apply to cases where procedures are performed.
In this ordinance revision, the provisions of the exemption pertaining to the "Regulation Law for Residential Land Development" have been partially changed with the promulgation of the "Law to Partially Revise the Regulation Law for Residential Land Development".

In July 2019, "Yamate-District" was newly added as a district (landscape promotion district) that focuses on landscape formation based on the Yokohama City Landscape Plan, in order to preserve the exotic cityscape and lush natural environment and to secure a view appropriate for Yokohama. We revised a part of the landscape regulations to determine acts subject to notification and acts subject to specific notification in this "Yamate-District".

The Landscape Act stipulates three acts that are subject to notification nationwide: acts such as building buildings, acts such as construction of buildings, construction of structures, and development activities. In addition, in the case of adding acts subject to notification, etc., it is stipulated in the ordinance.
In this ordinance revision, Yamate-District has added acts subject to notification in order to preserve the lush natural environment. At the same time, in order to preserve the good cityscape and promote the formation of a landscape appropriate for the district, we have established specific acts subject to specific notification.

• Based on the landscape ordinance, districts that need to create attractive cityscapes are defined as "Urban landscape consultation district”, And define the policy of the consultation, the act to be discussed, and design guidelines (action guidelines), etc.
• When you perform building of buildings in cityscape discussion district, please talk with Yokohama-shi based on policy and action guideline established beforehand.
• The standard processing period for urban landscape consultation is 50 days.
• Acts subject to consultation and contact points vary depending on the district.

• For historic buildings, compliance with the Building Standards Law is often an issue when large-scale renovations involving a change in use for utilization. By obtaining the consent of the Building Review Board based on the designation under this system, the Building Standards Law can be excluded, and it is possible to consider the well-balanced use of conservation and its utilization.
