Purpose of Law Revision

In April 2020, a law amending a part of the Health Promotion Law was fully enforced. The revised law prohibits smoking except for certain places in the facility according to the classification of facilities used by many people, especially for children and patients who have a particularly large health impact in order to prevent unwanted passive smoking. It also stipulates measures to be taken by the owner of the management right.

About passive smoking prevention measures required of company

Facilities used by a large number of people require measures to prevent passive smoking according to the type of facility.

Class 1 facilities (facilities used by children, patients, etc.) ※In principle, smoking cessation on premises

Schools, child welfare facilities, hospitals, clinics, government offices, etc.

Specific outdoor smoking areas and requirements required for installation

Specified outdoor smoking areas are smoking areas that can be installed in some places outside of first-class facilities where necessary measures have been taken to prevent passive smoking. The necessary measures have been established for installation.

Measures necessary for setting up specific outdoor smoking areas
Smoking areas are divided (e.g. partitions, draw lines on the ground)
Post a sign stating that it is a place where you can smoke (sign example (PDF: 29KB))
Install it in a place where people who use the facility usually do not enter.

※When setting up a specific smoking area, please make sure that you do not install it in a place adjacent to a nearby building.
※Taking such measures does not recommend the establishment of a specific outdoor smoking area.

Class 2 facilities (facilities other than Class 1 facilities used by multiple people) ※In principle, indoor smoking cessation

Restaurants, offices, factories, hotels, inns, passenger transport business Ships, railways, etc.

Technical standards for smoking rooms

Smoking rooms can be set up as an exception to indoor smoking cessation in Class 2 facilities in principle. When setting up a smoking room, it is necessary to post a sign that meets the legal requirements according to the situation of the facility. In addition, both customers and employees are not allowed to enter the smoking room under the age of 20.

If you want to set up a smoking room, you must meet the following technical standards:※
At the entrance, the airflow of air flowing into the room from outside the room must be at least 0.2 m per second.
To prevent tobacco smoke from flowing out of the room, it must be divided by walls, ceilings, etc.
Tobacco smoke is exhausted outdoors or outside

※ Only when entrances and exits come into contact with each other indoors.

Existing specified food and beverage facilities and smoking facilities

In principle, as an exception to indoor smoking cessation, all facilities that meet the requirements can smoke indoors.

Signs that need to be posted

In accordance with the Health Promotion Law, smoking facilities must sign a sign indicating that effect. (Penalties for violations: fines of 500,000 yen or less (outside site)) For examples of signs, please refer to the "Signs Required to Post" page.

(Because the number of facilities that can be dispatched is limited, it may not be possible to dispatch depending on the application status.)

Non-smoking areas

Based on "the regulations (outside site) about prevention of scattering such as empty cans of Yokohama-shi and butts", for the purpose of prevention of burns and scorching by lit cigarette, littering of butts, especially in the city, There are 8 areas around stations and downtown areas designated as smoking-free areas.

About outdoor smoking (except in areas where smoking is prohibited)

The Health Promotion Act requires smokers and smokers in smoking areas to take care to prevent unwanted passive smoking.

Consideration in places with lots of traffic

Unwanted passive smoking is more likely to occur in places with lots of traffic, such as around stations, around facilities used by many people, and sidewalks. Please take care to refrain from smoking in places where there are people around you.
Also, when smoking in ashtrays installed at entrances such as restaurants, be aware of whether passive smoking is not desired by people walking on the sidewalk or shop users.

Children need special attention because passive smoking has a great health impact. Please refrain from smoking around playground equipment in parks that are often used by children and on roads in contact with schools and nursery schools, etc., and pay special attention to whether tobacco smoke has reached children, and give consideration to the actions .

About smoking at home

Homes are the most susceptible to passive smoking among living together families, including children and partners. If you have a living together family or a child, please refrain from smoking at home and refrain from smoking.

Even if there is no one living together, it may be annoying to neighbors without knowing it.
・If you smoke in the garden or veranda, neighbors may be troubled with the smoke or smell.
・If you smoke under a ventilation fan, the smoke or smell may go out of the exhaust port and flow into the room through a nearby ventilation fan or ventilation vent.
Don't forget to take care of your surroundings when smoking, even in a private space.

The home is the most susceptible place for the living together family to passive smoking. Based on the effects of passive smoking on children, please refrain from smoking at home and ask for smoking cessation.
