Health Promotion Law
Purpose of Law Revision
In April 2020, a law amending a part of the Health Promotion Act was fully enforced. In order to prevent unwanted passive smoking, the revised law prohibits smoking except for certain places in the facility according to the classification of facilities used by many people, especially in consideration of children and patients who have a particularly large health impact. In addition, it stipulates measures to be taken by the right holder of management.
About measures to prevent passive smoking required for businesses
Facilities used by a large number of people need to take measures to prevent passive smoking depending on the facility type.
Class 1 facilities (facilities used by children and patients) ※In principle, smoking cessation on premises
Schools, child welfare facilities, hospitals, clinics, government buildings, etc.

Specific outdoor smoking areas can be set up.
Specific outdoor smoking areas and requirements required for their installation
Specified outdoor smoking areas are smoking areas that can be set up in some places outdoors of first-class facilities where necessary measures have been taken to prevent passive smoking. The necessary measures are defined for installation.

Technical standards for smoking rooms
Smoking rooms can be set up as an exception to indoor smoking cessation of Class 2 facilities in principle. When setting up a smoking room, it is necessary to post a sign that satisfies the legal requirements according to the situation of the facility. In addition, both customers and employees are not allowed to enter the smoking room under the age of 20.

Existing specific food service facilities and smoking facilities
In principle, an exception to indoor smoking cessation, facilities that meet the requirements can be allowed to smoke all indoors.

Signs that need to be posted
Based on the Health Promotion Law, facilities that can smoke must have a sign indicating that fact. (There are penalties for violations: fines of 500,000 yen or less (external site))) Please refer to the "signs that require notice" page for sign examples.

Smoking prohibited areas
Based on "the regulations (outside site) about prevention of scattering such as empty cans and butts in Yokohama-shi", for the purpose of prevention of burns and burnt by lit cigarette, prevention of littering of butts, there is particularly traffic in the city 8 districts where there are many stations and downtown areas are designated as smoking prohibited areas.

The Health Promotion Law requires smokers and smoker installers to take care to prevent unwanted passive smoking.
Consideration in places with a lot of traffic

In places with a lot of traffic, such as around stations, around facilities used by many people, and sidewalks, "unwanted passive smoking" is more likely to occur. Please refrain from smoking in places where there are people around you.
Also, when smoking in an ashtray installed at entrances and exits such as restaurants, be aware that passive smoking is unwanted for people walking on the sidewalk or shop users.
Consideration in places where children use

Children need special consideration because the health effects of passive smoking are large. Please refrain from smoking around playground equipment in parks that are often used by children, such as refraining from smoking around playground equipment in parks that are often used by children and on roads in contact with schools and daycare centers. .
