Existing specific food and beverage facilities (smoking rooms and smoking areas)

In principle, restaurants are banned indoors under the Health Promotion Law, but for restaurants that meet all of the following three requirements (existing specific food service facilities) that meet all of the following three requirements, transitional measures that allow some or all of the inside of the store can be smoked There is. When we receive application of transitional measures, report to Yokohama-shi is necessary. In addition, the period of transitional measures is not set.

１	Operating as of April 1, 2020
２	Capital or total investment of 50 million yen or less
３	Store seating ※The area of 100m2 or less (* A place where customers can eat and drink. The area of the entire store excluding kitchens, toilets, corridors, accounting cash registers, employee-only space, etc. )

※If there is any change in the situation after the enforcement of the law, whether or not it continues to fall under "existing restaurant" will be based on "business continuity", "identity of management entity", "identity of store", etc. Judgment will be made comprehensively. **To set up a smoking room, the following technical standards must be met.※**
１	At the entrance, the airflow of air flowing into the room from outside the room must be 0.2m / second or more.
２	It must be divided by walls, ceilings, etc. so that tobacco smoke does not flow out of the room.
３	Cigarette smoke is exhausted outdoors or outside

※Only when the entrance is in contact with the room. In addition, when the smoking room is set to “all facilities (= smoking stores)”, the technical standard of the smoking room is `` divided by walls, ceilings, etc. so that tobacco smoke does not flow out of the room. That is. However, since all facilities are treated as smoking rooms, both customers and employees cannot enter the store under the age of 20.

You are required to store the following documents. ※You do not need to submit it to Yokohama City.
1 Materials related to floor area of the seating area of the facility (store)　
　　<Example> Store drawings, etc.
2. If the facility (store) is managed by a company, materials related to the amount of capital or the total investment
　　<Example> Registration, balance sheets, financial statements, corporate brochures, etc. that describe the amount of capital and total investment.

Flow after notification

1 Check the contents of registration form, a facility with smoking rooms in Yokohama.　※Resubmission is required if there are any deficiencies.
2. Send a copy of registration form, sign sticker, etc. from Yokohama City to the registered store
3. The registered stores post signs at stores

Smoking facilities (smoking rooms, smoking areas, etc.)

Facilities whose main purpose is smoking (smoking facilities) can have a smoking room in part or all of the store if they meet the requirements. Both customers and employees are not allowed to enter smoking areas under the age of 20 and are obliged to post a sign indicating that effect. Smoking facilities are classified into "bars and snacks, etc. whose main purpose is to smoke", "public smoking areas", and "smoking tobacco stores that can smoke in the store".

※Only when the entrance is in contact with the room. If the smoking room is "all facilities (= smoking-purpose stores)", all facilities are treated as smoking rooms, so both customers and employees cannot enter the store under the age of 20 because all facilities are treated as smoking rooms.

Bars, snack, etc. for the main purpose of smoking

When setting up a smoking room in part or all of the facility as a bar snack for the main purpose of smoking, the following requirements must be met. (There are penalties for violations)
１	The main purpose is to provide a place to smoke.
２	Obtain a tobacco sales license (including a business trip license) and conduct face-to-face sales of tobacco
３	Do not provide meals that are normally recognized as staple food. (excluding lunch business)

In addition, it is mandatory to store documents that show information on tobacco sales permission, such as a copy of a tobacco sales permit letter and a business trip sales permit letter. （Penalties for violations: A fine of 200,000 yen or less (outside site)）

Signs that need to be posted

Signs must be posted in both smoking rooms, smoking areas, and smoking shops. (There are penalties for violations: fines of 500,000 yen or less (external site))) Please refer to the "signs that require notice" page for sign examples.
