Existing specified eating and drinking facilities (smoking rooms and smoking shops)

In principle, restaurants are prohibited from smoking indoors under the Health Promotion Law, but restaurants that meet all of the following three requirements (existing specific eating and drinking facilities) can smoke part or all of the store. There are measures. If you are subject to transitional measures, you need to notify Yokohama City. In addition, there is no fixed period for transitional measures.

１	Operating as of April 1, 2020
２	Total capital or capital investment of 50 million yen or less
３	Store seats ※The area of 100m2 or less (* Place where customers can eat and drink. The area of the entire store excluding kitchens, toilets, corridors, accounting cash registers, employee-only spaces, etc. )

※If there is any change in the situation after the enforcement of the law, whether or not it continues to fall under “existing restaurants” is based on “business continuity”, “sameness of management entities”, “sameness of stores”, etc. Judge comprehensively. **If you want to set up a smoking room, you must meet the following technical standards.※**
１	At the entrance, the airflow of air flowing into the room from outside the room must be at least 0.2 m per second.
２	To prevent tobacco smoke from flowing out of the room, it must be divided by walls, ceilings, etc.
３	Tobacco smoke is exhausted outdoors or outside

※Only when entrances and exits come into contact with each other indoors. In addition, when the smoking room is defined as "all facilities (= smoking shops)", the technical standard for the smoking room is "disclosed by walls, ceilings, etc. so that tobacco smoke does not flow out of the room. That's only. However, since all facilities are treated as smoking rooms, both customers and employees cannot enter the store under the age of 20.

Materials that must be preserved (penalties for violations: fines of 200,000 yen or less (external site))

It is mandatory to save the following documents. ※You do not need to submit it to Yokohama City.
1 Materials related to the floor area of the seats of the facility (store)　
　　<Example> Store drawings, etc.
2. If the facility (store) is operated by the company, materials related to the amount of capital or the total amount of investment
　　<Example> Registration, balance sheet, financial statements, corporate brochures, etc. that indicate the amount of capital and the total amount of investment

Flow after notification

1 Confirmed the contents of registration form, a facility with smoking rooms in Yokohama City　※If there are any deficiencies, resubmit is required.
2 Send copies of registration form, sign stickers, etc. from Yokohama City to registered stores
3 Notified stores display signs at stores

Smoking facilities (smoking rooms, smoking shops, etc.)

Facilities whose main purpose is smoking (smoking facilities) can set up smoking rooms in part or all of the store if they meet the requirements. Both customers and employees are not allowed to enter smoking areas under the age of 20, and are obliged to post a sign indicating that fact. Smoking facilities are classified into "bar snacks, etc. whose main purpose is smoking", "public smoking areas", and "cigarette stores where smoking can be done inside the store".

Bar snacks, etc. whose main purpose is smoking

When setting up a smoking room in part or all of the facilities as bar snacks mainly for smoking, the following requirements must be met. (There are penalties for violations)
１	The primary purpose is to provide a place to smoke
２	Obtaining tobacco sales permission (including business trip sales permission) and conducting face-to-face sales of tobacco
３	Do not provide meals normally recognized as staple food. (except during lunch business)

In addition, it is mandatory to keep documents that show information about tobacco sales permission, such as a copy of a tobacco sales permission notice and a business trip sales permission notice. （Penalties for violations: fines of 200,000 yen or less (outside site)）

Signs that need to be posted

Signs must be posted for both smoking rooms, smoking shops, smoking rooms, and smoking shops. (Penalties for violations: fines of 500,000 yen or less (outside site)) For examples of signs, please refer to the "Signs Required to Post" page.
