About road-like open space (Ordinance Article 18)

Ordinance Article 18 Clause 2 first (standard of consent) about adjustment of Yokohama-shi development business (standard of consent)

2 The criteria for consent of the development project shall be as follows.
（１） When the development project area touches a road under the Road Law (Law No. 180 of 1952), the horizontal distance from the center line of the road concerned is 2.25 meters or more along the contact part We establish open space to offer for public use with width to become and maintain in road shape. But it is not this limit when the mayor recognizes that there is no obstacle to the safety of traffic of the road concerned due to the shape of the development project area, surrounding conditions, etc.

　For roads less than 4.5 meters (roads under the Road Law) in contact with the development project area, it is stipulated that more than 2.25 meters should be widened from the center of the road, mainly to ensure the safety of local residents.

　There are many narrow roads in the city area, but since they are used as living roads for local residents, even if they do not widen according to the standards of development permission, open spaces with a width of 2.25 meters or more from the center of the road We will establish and maintain it in a road shape (this rule applies only to roads under the Road Law). However, if the roads before and after including the road do not have the current status form, there is no need for maintenance due to nearby land use or topography, etc., do not need to provide vacant lots.
Road-like vacant lots that have been maintained will continue to discuss attribution to Yokohama City so that the safety of local residents' traffic will be ensured.
In addition, since the open space prescribed in this issue needs to be maintained in a road shape, it cannot be duplicated with vacant lots referred to in No. 4 and No. 9. In addition, regardless of this rule, retreat of Article 42, Paragraph 2 of the Building Standards Act must be implemented.

1. When development business area touches road of Road Law less than 4.5 meters in width, establish 2.25 meters open space from center line of the road to development business area side from the center line of the road and maintain it in a road shape. But we correspond to any of the following, and the mayor (road manager) establishes open space and admits that it is not necessary to maintain in road shape, we may not establish open space.
   (1)　The part where road-like open space should be developed is the case where the road has already been widened due to previous development activities, etc., and the widening part belongs to Yokohama City
   (2)　Road-like open space contacts and roads that do not have the current status of roads that lead to the road.
   (3)　The part where road-like open space should be maintained can be judged to be difficult to provide vacant lots due to cliffs, etc., and to maintain them in a road shape.
   (4)　Those with almost no road users in contact with the part where road-like open space should be maintained
   (5)　The part where road-like open space should be developed is only for evacuation passage sites and drainage channels. Provided, however, that this shall not apply if the road adjacent to the part where the maintenance should be carried out has already been widened.
2. Maintenance of road-like open space shall be maintenance level that the mayor (road manager) established by the maintenance situation of road in contact with the part concerned (in principle, the maintenance level shall be equivalent to the road in contact with.) 。

• Each Public Works Office determines whether there is a road-like open space.
• When there is a notice of sign installation in Article 9 of the Ordinance, as necessary guidance and advice, we will provide a formal response to the presence or absence of road-like vacant lots.
