Ordinance Article 18 Clause 2 first (standards of consent) about adjustment of Yokohama-shi development business
2 The criteria for consent of development projects shall be as follows:
(1) If the development project area contacts a road under the Road Law (Law No. 180 of 1952) with a width of less than 4.5 meters, along the part in contact, the horizontal distance from the center line of the road is 2.25 meters or more Establish open spaces for public use with a width of more than 4.5 meters, and maintain them in a road shape. But it is not this limit when the mayor recognizes that there is no obstacle to traffic of the road by shape, the surrounding situation of the development business area concerned.
Purpose
For roads less than 4.5 meters in contact with the development project area (roads under the Road Law), it is stipulated that the width of 2.25 meters or more from the center of the road should be widened mainly to ensure the safety of traffic for local residents.
Commentary
There are many narrow roads in the city area, but since it is used as a living road for local residents, even if it is not widened according to the standard of development permission, it is more than 2.25 meters wide from the center of the road It is decided to establish an open space and maintain it in a road shape (this rule applies only to roads under the Road Law). However, if the road before and after including the road has no current status, there is no need to be maintained due to nearby land use or terrain, etc., there is no need to set up an open space .
The maintained road-like open space will continue to discuss attribution to Yokohama City, etc., so that the safety of traffic for local residents will be ensured.
In addition, since it is necessary to maintain the open space prescribed in this issue in a road shape, it cannot be duplicated with the open space referred to in No. 2 to No. 4 and No. 9. In addition, regardless of this rule, retreat of Building Standard Act Article 42 Clause 2 must be carried out.
Criteria
- If the development project area contacts a road under the Road Law with a width of less than 4.5 meters, establish an open space of 2.25 meters on the development project area side from the center line of the road and maintain it in a road shape. But we may not establish open space when we correspond to any of the following, and the mayor (road manager) establishes open space and admits that it is not necessary to maintain in road shape.
(1) The part where road-like vacant land should be maintained is when the road has already been widened due to previous development activities, etc., and the widening part belongs to Yokohama City
(2) Roads where the part where the road-shaped open space should be maintained is in contact with the road and the road connected to the road.
(3) The part where road-like vacant land should be maintained can be determined to be difficult to establish an open space due to cliffs, etc., and to maintain it in a road shape.
(4) There are few road users who come into contact with the part where road-like open space should be maintained.
(5) Only the evacuation passage site and drainage site should be maintained for road-like vacant land. Provided, however, that this shall not apply if the road adjacent to the part to be maintained has already been widened. - The maintenance of road-shaped vacant lots shall be the maintenance level determined by the mayor (road manager) according to the maintenance situation of the road in contact with the relevant part (in principle, the maintenance level shall be the same as the road in contact.) 。
