Various business procedures after revision of the Food Sanitation Law

Overview

The Food Sanitation Law was revised, and the Food Business Permit System was revised and a business notification system was established. Since the "Notification System" by law was newly created on June 1, 2021, the "Notification System" according to the rules of Yokohama City has been abolished. Depending on the content of the business, it is necessary to obtain a new business license or report a business, so please check the following information.

Transitional measures (those who start new business after June 1, 2021 are not eligible)

Those who have obtained a business license by May 31, 2021

It is possible to operate until the expiration date of the business license expiration date indicated on the business license (except for industries that have transitioned from permission to notification).
The next time you renew your business license, you will be required to obtain a license under the new law.

Those who have been manufacturing and selling foods that do not require a business license before May 31, 2021

Depending on the content of the business, it is necessary to obtain a business license or submit a business license.
In the case of business requiring a new business license

A business license under the new law is required by May 31, 2024.
Example) Those who manufacture pickles and those who manufacture sealed packaging foods

In the case of a business requiring a new business report

A business notification under the new law is required by November 30, 2021.
Example) Those who sell vegetables and those who sell lunch boxes

About business notification procedure

Those who are subject to notification

Those who do business other than "business licensed industries (32 industries)" and "industry that do not require notification" need to apply for a "business notification".
※When you correspond to more than one type of business, please select one representative industry (main type of industry) and report.
Please contact Health and Welfare Center Health Sanitation Division in the ward where the facilities are located.

Notification method

Procedures can be made at the Food Sanitation Application System (online system operated by the Ministry of Health, Labour and Welfare) or at the window of Health and Welfare Center Health Sanitation Division in the ward where the facility is located.

※When displaying food from a car and selling it, it does not correspond to a car business, but a notification is required for each sales location.

About the handling of industries that have shifted from permission to report

If you have obtained a business license for milk sales, meat sales (packaging products), seafood sales (packaging goods), seafood sales (packaging products), and ice and snow sales before May 31, 2021, it is considered that the business has already been notified. If these industries are "main industries", there is no need to submit a new notification.

Health and Welfare Center Health Sanitation Division will provide you with specific procedures before the expiration of the business license period.

Notification of convenience stores and supermarkets

If you are operating a convenience store or supermarket, there are cases where the type of business that is considered to have notified the business and the main type of business that is actually operating are different.

In the case of the above, please apply for a “business notification” again for the appropriate main industries.
In addition, please file a “business notification” procedure for the type of business that is deemed to have submitted a business report.

Example) Procedures for business operators of convenience stores that have been operating on or before May 31, 2021

Notification of business closure

Until now, in principle, reception at the window of Health and Welfare Center Health Sanitation Division in the ward where the facility is located or by mail, but this time you can now apply for the Yokohama City Electronic Application and Notification Service.

Precautions when submitting a business closure using the electronic application and notification service
  • If you go out of a business license, be sure to attach an electronic file of your business license. (e.g., a photo of a business license, a PDF file scanned of a business license, etc.)
  • Please discard your business license as soon as you receive the notice of completion of the closure notification.
  • If you have lost your business license, please fill out the remarks column of the notification of business closure, such as "Lost your business license" so that you can understand that you have lost it.

About business report of catering facility

When cooking operations are performed directly and the number of meals served is 20 or more.

For group catering facilities that are currently in operation as of June 1, 2021, a “business notification” procedure by the installer of the catering facility is required by November 30, 2021.

When cooking operations are performed directly and the number of meals served is less than 20 meals

Not applicable to the "Business Report" procedure.

When outsourcing cooking operations

Regardless of the number of meals, the contracted business operator must have a business license. In this case, it is not covered by the procedure of "business notification" by the installer of the catering facility.

Non-reported industries

If you conduct only the following business, you do not need a “business license” or “business notification” as a business that has little impact on public health.

  1. Importing food or additives
  2. Business that only stores or transport food or additives (excluding food freezers and refrigerated warehouses)
  3. Sales of packaging foods that do not cause harm to food hygiene due to corruption, loss, or other quality degradation even if stored at room temperature for a long period of time (e.g., snacks, cup noodles, alcoholic beverages, tea, etc.)
  4. Manufacturing of containers and packaging other than synthetic resins
  5. Import or sales of equipment containers and packaging
  6. Group catering facilities (when the contractor outsources cooking work has obtained permission, or facilities with less than 20 meals at a time)
  7. Food sampling business in agriculture and fisheries

Food sampling business in agriculture and fisheries

The following acts performed by farmers (producers) and producer groups are within the scope of the collection business, and no "business notification" is required.
 Example of act in the collection business
1Shipping preparation and preparation of agricultural products that do not involve shape change, which is integrated with fruit sorting and sorting before shipping.Peeling, washing, bagging, refrigeration, curure ring, drying, etc.

5Primary processing of agricultural products on the premise that it will be sold to manufacturers and processors for further processing

Collection of honey, crude sugar production, crude tea production, crude tea, salt storage of vegetables, etc.
Primary processing that uses food additives during the process (e.g. Kanpyo) is subject to notification


About business license procedure

Those who do business that fall under the “Business Permit Industry (32 industries)” need to obtain a business license in advance.
