Various business procedures after the revision of the Food Sanitation Law

Overview

The Food Sanitation Law was revised, and the food business license system was reviewed and a business notification system was established. Since the "Notification System" by law was newly created on June 1, 2021, the "Notification System" based on the rules of Yokohama City has been abolished. Depending on the content of the business, it will be necessary to obtain a new business license and report the business, so please check the following information.

Transitional measures (excluding those who start a new business after June 1, 2021)

Those who have obtained a business license by May 31, 2021

It is possible to operate until the expiration date of the business license specified on the business license (except for industries that have shifted from permission to notification).
The next time you renew your business license, you will be required to obtain permission under the new law.

Those who have been manufacturing and selling foods that do not require a business license before May 31, 2021

Depending on the content of the business, it is necessary to obtain and submit a business license.
In the case of business that requires a new business license

A business license under the new law is required by May 31, 2024.
Example) Those who manufacture pickles, those who manufacture sealed packaging foods

In the case of a business that requires a new business notification

A business notification based on the new law is required by November 30, 2021.
Example) Those who sell vegetables, those who sell lunch boxes

If it is difficult to determine whether the business is subject to permission or notification, please contact Health and Welfare Center Health Sanitation Division in the district where the facility is located.

About the procedure of business notification

Those who are subject to notification

Those who conduct business other than "business licensed industries (32 industries)" and "businesses that do not require notification" need to apply for "business notification".
※If you correspond to multiple industries, select one representative industry (main industry) and submit a report.
If it is difficult to determine whether the business is subject to a business notification, please contact Health and Welfare Center Health Sanitation Division in the district where the facility is located.

Notification method

You can apply at the Food Sanitation Application System (an online system operated by the Ministry of Health, Labour and Welfare) or at the counter of Health and Welfare Center Health Sanitation Division in the district where the facility is located.

※When selling food from a car and selling it on display, it does not correspond to business by car, and a notification is required for each sales location.

About the handling of industries that shifted from permission to notification

If a business license was obtained prior to May 31, 2021 for "milk sales business", "meat sales (packaged goods), seafood sales (packaged goods)", and "ice and snow sales", it is deemed that the business has already been notified in accordance with the revision of the law. If these industries are "main industries", there is no need to submit a new notification. .

※Regarding business procedures such as vending machines, which will shift from licenses other than those listed above to registered industries, Health and Welfare Center Health Sanitation Division will guide you through specific procedures before the expiration of the license expiration date.

Notification of convenience stores, supermarkets, etc.

If you are operating at a convenience store or supermarket, there are cases where the type of business that is deemed to have been notified of business is different from the main type of business that actually operates.

In the case of the above, please apply for a “business notification” again for the appropriate main industries.
In addition, for the type of business that is deemed to have been notified of business, please follow the procedure of "closed business notification".

Example) Procedures for convenience store operators who have been operating before May 31, 2021
1Submission of “business notification” for “convenience stores” which are the main industries.
2Submission of “Closed Notification” for “milk sales business”, “meat sales business (packaged products)”, and “seafood sales business (packaged products)” that are deemed to have been notified of business.

About closing notice

Until now, in principle, it was accepted at the window of Health and Welfare Center Health Sanitation Division in the ward where the facility is located or by mail, but now the Yokohama City Electronic Application and Notification Service is now available.

Precautions when submitting a business closure report using the electronic application and notification service
  • Business license When closing a business, be sure to attach an electronic file of the business license. (Example: photos of business permits, PDF files scanned business permits, etc.)
  • After the notice of completion of the business closure notification has been received, please destroy the business license immediately.
  • If you have lost your business license, please write in the remarks column of the business closure report so that you can see the loss, such as "I lost your business license", and follow the procedure.

About business notification of lunch facility

When cooking is performed directly and the number of meals served is 20 or more.

For group catering facilities currently in operation as of June 1, 2021, the procedure for "business notification" by the installer of the catering facility is required by November 30, 2021.

When cooking is performed directly and the number of meals served is less than 20 meals per meal

It is not subject to the "Business Notification" procedure.

When outsourcing cooking operations

Regardless of the number of meals, the contractor must have a business license. In this case, it is not subject to the procedure of "business notification" by the installer of the catering facility.

About industries that are not notified

If you only perform the following business, you do not need a “business license” or “business notification” as a business that has little impact on public health.

  1. Importing of food or additives
  2. Business that only stores or transports food or additives (excluding food frozen and refrigerated warehouses)
  3. Sales of packaging foods (e.g. snacks, cup noodles, alcohol drinks, teas, etc.) that do not cause food hygiene hazards due to spoilage, deterioration or other quality deterioration even if stored at room temperature for a long period of time (e.g. snacks, cup noodles, alcohol drinks, teas, etc.)
  4. Manufacture of equipment containers and packaging other than synthetic resins
  5. Import or sales of equipment containers and packaging
  6. Group lunch facilities (facility less than 20 meals at a time when a contractor outsources cooking work has obtained permission)
  7. Food collection business in agriculture and fisheries

About food collection business in agriculture and fisheries

The following acts performed by farmers (producers) and producer groups are within the scope of the collection business, and a "business notification" is not required.
 Examples of activities related to collection
1Preparing shipments of agricultural products that do not involve changes in shape, implemented integrally with sorting and sorting before shipping.Peeling, washing, bagging, refrigeration, curing, drying, etc.
2Drying, preparation, and storage of grains, which are integrated with sorting and sorting before shipping.Drying, preparation and storage of grains in country elevators, rice centers and agricultural warehouses

Sales of unprocessed fruits and vegetables (including fruits and vegetables prepared for shipment corresponding to 1 and 2)

Act of direct sales to consumers (manned and unmanned direct sales outlets, online shopping)
Acts of selling through contractors

4Simple processing of agricultural products

Milling (milling, milling) ※However, when performing as a business (by contracting, etc.), it is subject to notification.
Drying, sun-dried (daikon dried, dried mushrooms, etc.)

5Primary processing of agricultural products on the premise that they will be sold to manufacturers and processors for further processing.

Collection of honey, production of crude sugar, production of crude tea, salt storage of vegetables etc.
Primary processing using food additives during the process (e.g., Kanpyo) is subject to notification.
