Information on Administrative Appeals Examination System

Last Updated March 31, 2023

About request for examination

Based on the Administrative Appeals Examination Law (Law No. 68 of 2014), the Administrative Appeals Examination System is based on a fair procedure when the rights and interests of the people (citizens) are violated by illegal or unlawful disposition or omission by the administrative agency. Under this system, it is a system to ensure the proper operation of the government.
Difference from trials
The difference from an administrative case lawsuit is that the request for examination is (1) a procedure based on written hearing, and (2) no fee is charged (however, a fee is required when receiving a copy of evidence). 3. Not only the illegality of the disposal but also the unfairness of the disposal may be examined.
Difference from public hearing
The request for examination is intended for dispositions or omissions by the administrative agency. Therefore, dissatisfaction with the staff's response or the system stipulated by laws and regulations are not subject to hearing. Opinions on the staff's response and system are heard in "Proposals from Citizens".
Difference from requests for information disclosure
The Civic Affairs Bureau Citizen Information Division is in charge of requests for requests for information disclosure and non-disclosure decisions for personal information disclosure requests.

About standard hearing period

The standard hearing period (the standard period that should normally be required after the request for examination arrives at the office until the decision is made on the request for examination is made by the The Mayor of Yokohama.) 。
In addition, since the standard hearing period is an indication of the hearing period, if the applicant for examination has made a request that he / she does not wish to consult the Yokohama City Administrative Appeals Examination Committee, there is a petition for an oral opinion statement In some cases, the hearing period may vary depending on the content of the request for examination.
