Flow from billing to decision

The following figure shows the flow from the request for examination to the decision. (Only if The Mayor of Yokohama becomes the Examining Authority.)

① Disposal
The subject of the examination request is "disposal of the administrative agency and other acts that exercise public power." Specifically, this includes non-permission disposal based on laws and regulations. Continuous facts (such as accommodation of people and detention of objects).
In addition, a request for examination can be made even if the administrative agency does not take any action (in omission) for an application based on laws and regulations.
② Invoice for examination
If you are dissatisfied with the disposition and request a request for cancellation of the disposition, etc., in principle, submit a request for examination.
The submission of the examination request is, in principle, The Mayor of Yokohama for disposal performed by the mayor, Director General and ward Health and Welfare Center mayor. However, please note that there may be special provisions for the Examining Agency under individual laws (the submission address is stated in the disposal notice.) 。 Examination request can also be submitted via the Disposal Section (Disposal Agency).
If the Disposal Agency and the Examining Agency are different (in the case of disposal by Director General or the ward of Health and Welfare Center), please submit a total of two examination requests, one copy for each copy (if The Mayor of Yokohama is a disposal agency, the original copy is fine.) 。
③ Nomination of the examiner
The proceedings will be carried out by the examiner. The Examining Authority appoints an examiner and notifies the requester for examination.
④ Submission of a statement
The examiner will send a request for examination to the Disposal Agency and request the submission of a statement (a document explaining the reason for the disposal). When a statement is submitted by the Disposal Agency, the examiner will send a statement to the requester.
⑤ Submission of a counter-argument
The requester may submit a counter-argument against the statement. When submitting a counter-argument, please submit it by the deadline specified by the examiner.
⑥ Submission of a written opinion of the examiner
The examiner will examine the assertions and evidence of both the requester and the Disposal Agency, and when completing the necessary hearing, concludes the hearing procedure. We make statement of opinion of hearing member (the original draft of decision) and submit to examination agency.
⑦ Advisory to the Yokohama City Administrative Appeals Board
When the Examining Agency receives a statement of opinion, it consults a third-party organization (Yokohama City Administrative Appeals Examination Committee) about the way of thinking about the ruling.
⑧ Report
After conducting a survey and deliberation, the Yokohama City Administrative Appeals Examination Committee will send a report to the Examining Agency.
In addition, we will delete personal information and announce the contents of the report.
⑨ Decisions
Based on the report, the Examining Agency prepares a decision and sends it to the requester for examination.

※Requests for examination regarding information disclosure and personal disclosure of personal information, and requests for examination when the administrative committee or affiliated organization is designated as the Examining Agency by law are different from the above flow.
