Flow from Request to Decision

The flow from the request for examination to the decision is as shown in the following figure. (Only if The Mayor of Yokohama becomes the Examining Agency.)
Flow of Requests for Examination
① Disposal
The subject of the request for examination is "disposition of administrative agencies and other acts that exercise public power." Specifically, this includes non-permission dispositions based on laws and regulations. Continuous acts (such as detention of people or detention of objects) are also included.
In addition, a request for examination can be made even if the administrative agency does not take any action for an application based on laws and regulations (inaction).
② Request for Examination
If you are dissatisfied with the disposition and make a request for examination seeking cancellation of the disposition, etc., in principle, submit a request for examination.
Requests for examination are submitted by the Mayor, Director General and Mayor Health and Welfare Center, in principle, The Mayor of Yokohama. However, please note that there may be special provisions for the Examining Agency under individual laws (the submission destination is described in the disposal notice.) 。 The examination request can also be submitted via the Disposal Section (Disposal Agency).
If the Disposal Agency and the Examining Agency are different (in case of disposal by Director General or ward Health and Welfare Center), please submit a total of two requests for examination, one copy of each copyThe Mayor of Yokohama is fine. 。
③ Nomination of a hearing officer
The hearing procedure will be conducted by the hearing officer. The Examining Agency appoints a examiner and notifies the requester.
④ Submission of a statement
The examiner will send a request for examination to the Disposal Agency and request the submission of a statement (a document explaining the reason for the disposal). When a statement is submitted by the Disposal Agency, the examiner will send a statement to the requester for examination.
⑤ Submission of refute
The requester may submit an objection to the statement. When submitting a counter-argument, you must submit it by the deadline specified by the examiner.
⑥ Submission of a hearing officer's opinion
The examiner will examine the claims and evidence of both the requester and the Disposal Agency, and will close the hearing procedure when the necessary hearing is completed. Create a statement of opinion (the original draft of the ruling) and submit it to the Examining Agency.
⑦ Consultation to the Yokohama City Administrative Appeals Examination Committee
When the Examining Agency receives the submission of a written opinion of the examiner, it consults with a third-party organization (Yokohama City Administrative Appeals Examination Committee) about the way of thinking about the ruling.
⑧ Report
After conducting the investigation and deliberation, the Yokohama City Administrative Appeals Examination Committee sends a report to the Examining Agency.
In addition, we will delete personal information and publish the contents of the report.
⑨ Letter of Decision
Based on the report, the Examining Agency prepares a decision and sends it to the requester for examination.
※Requests for examination of information disclosure and personal disclosure of personal information, and requests for examination when the administrative committee or affiliated organization is referred to as the Examining Agency by law are different from the above flow.
