What is the Public Expansion Act?

Local governments, etc. have institutionalized to make it easier for local governments to acquire the land necessary for the development of public facilities. It is a pre-purchase system.
This system includes a notification under Article 4 of the Public Expansion Act and an application under Article 5 of the Public Expansion Act.

[Notification under Article 4 of the Public Expansion Act] The Public Expansion Law is a prior notification.

When attempting to transfer land in Yokohama that meets certain requirements, land owners must notify The Mayor of Yokohama in advance. If local governments wish to purchase the land, they can preferentially discuss the purchase.

[Application pursuant to Article 5 of the Public Expansion Act]

When we hope for purchase from local public entities about land more than 200 square meters in Yokohama-shi, we can report to the mayor.

Restrictions on land transfer

If you submit a notification of the Public Expansion Law, the transfer of land will be restricted for a certain period.

  1. From the date of notification until three weeks have elapsed from the date of notification. (If there is a notice that you do not wish to purchase, until that day.)
  2. If there is a notice that there is a purchase request, until three weeks have elapsed from the date of the notice. (If it is clear that the purchase consultation will not be established, until then.)

Benefits under tax law

If a contract is concluded by the application of the Public Expansion Law, you can receive preferential treatment under tax law (special deduction of transfer income of 15 million yen). (Consultation with the tax office is required.)

Penalties

Those who fall under the following may be fined 500,000 yen or less.

  1. A person who has transferred the land for a fee without notification.
  2. A person who has made a false report.
  3. A person who has transferred the land within the transfer restriction period.
