Deletion of registration of repurchase agreements (designation for single-family use for general competitive bidding)

Overview

 When we purchase article with repurchase agreement by municipal ownership land open call for participants sale and correspond to the following requirements, we can apply for cancellation of the registration concerned.
 In addition, after April 1, 2023, if 10 years have passed since the date of the sales contract for which the repurchase agreement was made, it is now possible to delete the repurchase agreement with the owner's sole application. For details on procedures, etc., please check with the relevant Legal Affairs Bureau or judicial scrivener.

Requirements

  • Provided as a site for a detached house (a dedicated house where one household lives in a single building)
  • The contract period has expired

 However, if all of the following requirements are met, you can apply for deletion of registration even before the expiration of the period.

  • A detached house is built and an inspection certificate has been issued.
  • A sales contract with a third party has been concluded (there is a contract aimed at transferring ownership of the property).

 In order to cancel the repurchase agreement, an application by application form is required.
 If you are interested, please prepare a municipal property sales contract and contact us.
 ※In the case of cancellation before the expiration of the period, the application form must include the registered seal of a third party (the person whose ownership is transferred) and the private seal certificate. An application form will be sent before concluding a sales contract with a third party, so please contact us as soon as possible.

About Waiting with a judicial scrivener at the Legal Affairs Bureau

 By making advance adjustments, judicial scriveners and city officials can meet at the Legal Affairs Bureau and apply at the same time. Please use it when it is necessary to change the land pattern of the property for sale, correct the land area, etc., and you want to make a special contract cancellation by the settlement date. However, if you wish, please submit a cancellation application form and contact a judicial scrivener at least three weeks before the registration application date (payment date).

Costs

 The cost of the application will be borne by the applicant. An income stamp with a face value of 1,000 yen is required for each brush of application.
※If you apply for two or more brushes, please prepare a 1,000 yen stamp for several brushes. If you attach one stamp with the number of brushes x 1,000 yen despite applying for multiple brushes, only one application for one brush will be received according to the provisions of the Legal Affairs Bureau.

About after application

 If there is no error in the content of the application, the deletion of the registration will be completed within 2-3 weeks from the date of application.
 Once the registration has been deleted, the notice will be mailed to the applicant or the scanned data will be sent by email.

Procedure Department

 The application for cancellation of the repurchase agreement registration is the contract department (or the handover department of the contract department) at the time of purchase the municipal property.
 If the person who repurchase the certificate of all registration matters is other than "Yokohama City", such as "Yokohama City Housing Supply Corporation", it cannot be handled.
 If you do not know the contract department, please contact us after preparing a municipal property sales contract.
 If you have lost your contract, please obtain a certificate of all matters in Yokohama Legal Affaires Bureau and let us know the following information.

  • Lot number of the land at the time of the contract
  • Date of transfer of ownership from Yokohama City to purchaser

 The jurisdiction of Yokohama Legal Affaires Bureau will change depending on the location of the area.
 Please contact Yokohama Legal Affaires Bureau (external site) for details on jurisdiction, how to obtain a certificate of all matters, fees, etc.

 When contract is lost, request such as grant of copy of contract from third party (person who received request from contractor with city) cannot be received. Also, providing information such as contract details may be subject to disclosure requests.
 Regarding requests from the person, we do not respond over the phone because it is necessary to verify the identity. Please be careful.
