For administrative documents and disclosure requests of retained personal information, we explain examination requests for decisions made by the city.
If you are dissatisfied with the disclosure decision, etc., you can request a review within three months based on the Administrative Appeals Law.
If you are dissatisfied, you must submit a request for examination within three months from the day following the day when you know that there was a disclosure decision (= the date on which the decision letter for the disclosure request was sent). You can request a review by submitting it to the executing agency (the section in charge of disclosure decisions).
The executing agency does not examine it by itself, but consults with the Yokohama City Information Disclosure and Personal Information Protection Review Board, respects the report of the review committee, and makes a decision (if all requests for examination are accepted, the request for examination is Unlawful.) 。 As a result, we are conducting fair and neutral hearings.
Administrative Procedure
If you are dissatisfied, you may file a "litigation for cancellation of decision-making" with the Yokohama District Court based on the Administrative Case Procedure Law (within six months).
■ Flow of Requests for Examination of Disclosure Decisions, etc.
1 Submission of a request for examination-Examination by the executing agency
The executing agency that has received the request for examination will first examine the form of the examination request.
Regarding a legal request for examination, we will examine the claim of the requester for examination and, when it is determined that all disclosure can be made, make a decision to approve the request for examination.
When we think that non-disclosure, partial disclosure should be maintained, the executing agency will consult the Yokohama City Information Disclosure / Personal Information Protection Examination Committee, receive a report, respect it, and make a decision. .
The period until consultation is conducted is generally within 30 days (within 90 days if there are special circumstances such as when the number of target documents is large and it takes time to investigate and examine).
2 Consultation-Investigation and deliberation of the examination committee-Report
The executing agency that consulted will notify the requester of the examination, along with the statement (a document stating the reason for the non-disclosure decision, etc.) that the consultation was made, and request the submission of a counter-argument. I will do it.
In addition to being able to submit a counter-argument, the requester may submit a claim to the Board.
All deliberations of the Board, including statements, will be made private.
The Examining Committee will actually confirm the documents to be claimed, conduct necessary investigations and deliberations, and report whether the original disposal is appropriate. A copy of the report will also be sent to the requester.
3 Decision by the executing agency that received the report
The Executing Agency respects the report and makes a decision, and sends a copy of the decision to the requester for examination.
The period from the report to the decision is generally within 30 days (within 60 days if there are special circumstances such as a large number of target documents).
■ How to make a request for examination related to disclosure decisions, etc.
Items to be described (Article 19 of the Administrative Appeals Law)
- Date of request for examination
- Name and address or residence of the requester
- If you request a review by proxy/agent (legal representative, voluntary proxy/agent), please include your name and address of proxy/agent.
- When requesting examination under the name of a corporation, etc., it will be the job title, name and address of the representative etc.
- Disposal pertaining to the request for examination
- Date when we learned that there was a disposition pertaining to the request for examination
- Purpose and reason for the request for examination
- Whether or not there is teaching by the executing agency and its contents
attached documents (Article 4, Paragraph 2 of the Enforcement Order of the Administrative Appeals Law)
- When requesting an examination by proxy/agent - Documents certifying the right of representation
- In the case of legal representative, a copy of the family register, etc., which shows the legal relationship.
- In the case of a voluntary proxy/agent, a power of attorney from the principal
- When a corporation requests examination-Documents certifying the qualifications of a representative, etc.
- In the case of a corporation, a copy of the corporate register, etc.
- In the case of an association or foundation that does not have a legal personality, the rules and the minutes of the general meeting with a record of appointing a representative, etc.

■ Submission of a request for examination related to disclosure decisions, etc.
Please submit one request for examination pertaining to disclosure decisions by mail or to the counter.
When submitting by mail, please send it to the section in charge that made the disclosure decision.
When you submit to window, please submit to any of the following windows.
- Citizen information center on the third floor of city hall (if you submit here as much as possible, we can accept immediately.)
- Public Relations Section of each ward office
※ Submitted documents will not be returned, so if you need a copy, please bring it yourself. In addition, at the counter, only one copy of the submitted documents is given as a copy.
※ Hours is from 8:45 a.m. to 5:00 p.m. Monday through Friday (excluding national holidays and New Year's holidays).
■ Request for an oral statement
The requester for examination may offer an oral statement to the executing agency and the examination committee. It is basically conducted by the executing agency, but the screening committee will not be conducted if it is deemed unnecessary.
