 On May 27, 2022, in order to protect the lives and bodies of the people from disasters caused by embankments, etc., the Residential Land Development Regulation Law (hereinafter referred to as the "Old Residential Building Act") was drastically revised to protect the lives and bodies of the people from disasters caused by embankments, etc. (hereinafter referred to as the "Element Regulations") was promulgated.
 The response of Motoichi in response to this is as follows.

Regulation without skimming

  • Prefectural governors, etc., designates areas that can cause damage to houses, etc. by embankments, etc., regardless of the use of land such as residential land, agricultural land, forest, etc.
  • Permits, etc. performed in restricted areas, including the creation of farmland and forests and temporary accumulation of debris, are subject to permission.

Ensuring safety of embankments, etc.

  • Permission criteria necessary for disaster prevention are set according to the topography, geology, etc. of the area where embankment is performed.
  • In order to confirm whether safety measures are being taken in accordance with the permission criteria.

Clarification of where responsibility lies

  • Clarify that landowners, etc. have a responsibility to maintain a safe state for land where embankments were carried out.

Effective Penalties

  • Reinforce penalties for unauthorized acts and violations of orders, etc. to a higher level than the upper limit of penalties under the regulations so that penalties can function sufficiently as deterrence
