Where consultation is required

2. When applying for confirmation, etc. on a site in contact with the “maintenance promotion route” (mandatory consultation)

Of the roads stipulated in Article 42, Paragraph 2 of the Building Standards Act, when making a confirmation application on a site that is in contact with a road designated as a "maintenance promotion route"
It is obligatory to apply for a narrow consultation 30 days before applying for confirmation.
※Roads stipulated in Article 42, Paragraph 2 of the Building Standards Law are not subject to obligations if they are not designated as maintenance promotion routes.

[Procedures for which narrow consultation is required in advance]

  1. Article 6, Paragraph 1 of the Building Standards Act and Article 6-2, Paragraph 1 (including cases where it is applied mutatis mutandis in Article 88, Paragraphs 1 and Paragraph 2 of the Act)
    Application for confirmation based on the provisions of
  2. Application for permission prescribed in Article 43, Paragraph 1 of the City Planning Act
  3. Application for permission prescribed in Article 44, Paragraph 1, Item 2 or Item 4 of the Building Standards Act
  4. Application for certification prescribed in Article 137-16 No. 2 of the Building Standards Law Enforcement Order
  5. Application for permission prescribed in Article 4-3, Paragraph 5, Item 1 of the Yokohama City Building Standards Ordinance
  6. Application for permission to prescribe in regulations Article 14 about restrictions such as buildings in area of Yokohama-shi city planning

When using a subsidy system to perform retreat maintenance on a site that is in contact with the “maintenance promotion route”.

Even if a confirmation application is not accompanied by a confirmation application on the site in contact with the road designated as a "maintenance promotion route", it is necessary to apply for a narrow consultation when using the auxiliary system to perform retreat maintenance.

Exclusion of business

When we correspond to any of the following, we narrow and become out of target of road widening maintenance business.

  • When conducting development activities with the permission prescribed in Article 29 of the City Planning Act
  • When performing construction related to residential land development with the permission prescribed in Article 8 of the Regulation Law for Residential Land Development
    (Excluding construction work performed to maintain retreat sites, etc.)
  • When the land readjustment project is implemented with the approval of Article 4, Paragraph 1 of the Land Readjustment Act
