Pre-acquisition system for urban planning road business

This system purchases city planning road sites before commercialization based on applications from landowners on predetermined routes and districts.

Difference from land acquisition after commercialization

This is a procedure based on voluntary application from landowners.

Before commercialization, it is necessary for the landowner to prepare the application form and arrange the attached documents.
attached documents requires a certificate of entry for land and buildings, a copy of official map, and a land area survey map, all of which can be obtained from the Legal Affairs Bureau (outside site).

Expenses may be incurred.

In the advance acquisition system, only the part within the city planning decision line will be purchased in vacant lots in principle.
Therefore, when a part of the land protrudes from the city planning decision line, it is necessary to register the land separately.
Yokohama City will carry out surveying work to determine the acquired area, but for registration of land pens and map correction (if necessary), including the arrangement of a land and house investigator, all application procedures and cost burden, including the arrangement of a land and house surveyor. Please go to the landowner.
In addition, since it will be acquired in a vacant lot, if there is a property such as a building, it is necessary to remove it at the owner's expense.

Transfer income is not subject to special deduction

Prior to commercialization, the special deduction for transfer acquisition pursuant to Article 33-4 of the Special Taxation Measures Law will not be applied.
However, if the acquisition area is 200 square meters or more, tax deductions may be obtained by procedures based on the "Law Concerning the Promotion of Expansion of Public Land".

You may not be able to buy it at the desired time.

The period from consultation to the conclusion of the contract is approximately two years.
However, if any of the following apply, it may take some time to conclude the contract.
・When there is a property such as a building
・When the adjacent road waterway boundary or private land boundary has not been determined
・When the loan from the country to which it is funded cannot be secured satisfactorily.
・When the budget is reached with a large number of applications
・In cases where there are other individual circumstances

Conditions for Advance Acquisition

Routes subject to pre-acquisition

In principle, vacant land

Even if there is a building at the time of application, it is certain that the building can be removed by the time the contract is concluded. ※If so, you can apply.
Even if there are tenants at the time of application, it is certain that all tenants will be removed by the time the contract is concluded. ※If so, you can apply.

The percentage of land rights is organized.

Even if the percentage of land rights is not organized at the time of application, it is certain that the percentage of rights will be reorganized by the time the contract is concluded. ※If so, you can apply.
※You need to submit a written oath.

No mortgages and other rights have not been set on land and buildings

Even if various rights such as mortgages are set at the time of application, it is certain that the rights will be erased by the time the contract is concluded. ※If so, you can apply.
※You need to submit a written oath.

Land that can determine the adjacent road waterway boundary and private land boundary boundaries.

As a general rule, Yokohama City will determine the boundary between the application site and the adjacent Yokohama City-managed roads, etc., but we may ask the landowners to cooperate with the landowners regarding witness requests to neighboring landowners .
In addition, it is necessary for the land owner to determine the boundary between the application site and the adjacent private land. If the boundary is undecided, you will need to confirm the site with all the adjacent landowners and exchange a boundary confirmation letter.

The land must not be a land that may hinder maintenance

Depending on the local situation, pre-acquisition may not be performed.

Procedure Flow

01. Prior consultation [Land Owner → Yokohama City]

First of all, please feel free to contact us by phone or email.

02. Submission of “Land Advance Acquisition Application” [Land Owner → Yokohama City]

Please attach "certificate of land and building registration", "copy of official map", "land area survey map" to application form.
※Please be sure to consult with us before submitting the application form.

03. Preliminary survey [Yokohama City]

In order to determine whether or not to acquire, we will conduct field surveys such as surveying and material surveys.
As a general rule, only the inner part of the city planning decision line can be obtained. In addition, even if it is inside the city planning decision line, land that may interfere with maintenance will not be eligible for acquisition.
The survey will be conducted by the Yokohama City staff or a contractor contracted by Yokohama City.
Please note that you may be able to enter the site or take photos during the survey.

04. Holding of Land Advance Acquisition Coordination Committee [Yokohama City]

Regular meetings are held on a quarterly basis (March, June, September and December).
Based on the results of the preliminary survey, we will examine the projects you have applied for.

05. Notice of Acquisition Results [Yokohama City → Land Owner]

Notify the landowner in writing of the result of consulting with the committee.

06. Registration of handwriting (if necessary) [Land Owner]

When you decide to acquire a part of the land you have applied for, please register a pen writing based on the survey results of Yokohama City.
Regarding the registration of writing brushes and map correction (if necessary), it is necessary for the landowner to perform all the application procedure, including the arrangement of a land and house investigator, and all expenses.

07. Submission of “Consent Form” [Land Owner → Yokohama City]

It is written consent about receiving "designation of planned business site" based on Town Planning and Zoning Act Article 55 Clause 1.
In the land that has been designated as the planned business site, no building permit will be granted.

08. Land Survey [Yokohama City]

A real estate appraiser commissioned by Yokohama City will conduct a survey to calculate the value of the land to be acquired.

09. Public notice of designation of planned business site [Yokohama-shi]

A public notice will be issued in the city bulletin.

10. Notice of non-permission of building with designation of planned business site [Yokohama-shi → land owner]

In the land designated as the planned business site, we will notify you in writing that any future building permit will not be granted.

11. Submission of "Land Purchase Application Form" [Land Owner → Yokohama City]

12. Price presentation [Yokohama → Land Owner]

We will present the price of the land in writing.
The proposed price is based on a fair survey, so we cannot negotiate the amount at all.
Whether or not to contract or not depends on the landowner.
In addition, even if the contract is not established, "Designation of the planned business site" cannot be canceled.

13. Conclusion of contract

Once you have your consent at the presented price, we will proceed with the contract conclusion procedure.
If there are buildings, etc., it is necessary for the landowner to remove the buildings and clear the land by the time the contract is concluded.
If various rights such as mortgages are set on the land, the landowner must delete them by the time the contract is concluded.
Also, if the rights ratio is not organized or if there is a tenant, it is necessary to resolve those issues before the conclusion of the contract.

14. Land ownership transfer registration [Yokohama City]

After the contract is concluded, Yokohama City will immediately proceed with the registration of ownership transfer.

15. Land price payment [Yokohama → Land Owner]

As soon as the transfer of ownership is confirmed, we will pay the full amount of the land price.

16. Completion
