About the examiner

Under the Administrative Appeals Examination Law, in order to enhance the fairness and transparency of hearings, the staff who review requests for examination are legally positioned as `` trial members ''. (Based on the provisions of Article 9 of the Act, if the superintendent of education becomes the Examining Agency, a hearing member will be appointed. No appointment is required if the Board of Education becomes the Examining Agency. ) 。
The examiner will be an employee belonging to the Examining Authority appointed by the Examining Authority (City of Yokohama, Board of Education Secretariat employs a lawyer as an employee for fiscal year appointment and nominates them as examiners). From the viewpoint of ensuring that the hearing is conducted fairly, it is stipulated that anyone involved in the disposal procedure cannot be appointed as hearing members (Article 9, Paragraphs 1 and 2 of the Act) .
The examiner receives a statement from the Disposal Agency, etc., and a counter-argument statement from the requester of examination, etc., conducts necessary investigations, etc., and submits the results of the hearing on the decision to be made by the Examining Agency (a written opinion). ) And submitted to the Examining Agency along with the case record.
In addition, pursuant to the provisions of Article 17 of the Act, when the Examining Agency prepares a list of persons to be judges, it shall make it public.

Article 9 An administrative agency for which a request for examination has been made pursuant to the provisions of Article 4 or other laws or ordinances (including administrative agencies that have been taken over pursuant to the provisions of Article 14 Hereinafter referred to as the “Examining Agency”) shall designate a person belonging to the Examining Agency (in the case of preparing a list prescribed in Article 17 is prepared, the persons listed in the list) and shall notify the requester of the examination and the Disposal Agency (limited to the disposal agency other than the Examining Agency) of that fact. A committee prescribed in Article 49 (1) or (2) of the Act on Establishment of the Cabinet Office or Article 3 (2) of the Act on Establishment of the Cabinet Office or Article 3 (2) of the National Administrative Organization Act
An organization prescribed in Article 37 or 54 of the Cabinet Office Establishment Act or Article 8 of the National Administrative Organization Law
(Iii) a committee or member prescribed in Article 138-4, paragraph (1) of the Local Autonomy Law (Act No. 67 of 1947) or an organization prescribed in paragraph (3) of that Article.
(2) The person designated by the Examining Agency pursuant to the provisions of the preceding paragraph shall be a person other than those listed below.
(I) A person who has been involved in a decision on a disposition pertaining to a request for examination or a request for a reexamination pertaining to the disposition, or a person who is involved in or will be involved in a disposition pertaining to an omission pertaining to the request for examination.
