1 How to check roads under the Building Standards Law

Please confirm classification of road in Building Standard Act in "designated road map". In addition, we do not accept telephone inquiries because the impact of mistakes is large.

In addition, development permission number is displayed in the case of road by development among No. 1 No. 2 roads, and designated number and designated date are also displayed in the case of No. 1 No. 5 road (location designated road).

2 Roads, etc. under the Building Standards Law (Article 42 of the Act)

The definition and examination of roads, etc. posted on the designated road map are as follows.

※Please note that there are some public roads and public roads that do not fall under the Building Standards Law.
※The "width" in Article 42 of the Act is the part used for general traffic (commonly known as the "current width"). * Part in the figure) refers to the gutter, which is included in the "width", but please note that the law and retaining wall cannot be included in the "width".

Road No. 1, No. 2	Roads with a width of 4m or more according to the City Planning Act, Land Readjustment Act, etc. Roads built by development activities based on the City Planning Act For details on locations, etc., please refer to the "Development Directory" that can be viewed at the Housing and Architecture Bureau Information Consultation Section (Yokohama Building Information Center on the 2nd floor of the City Hall). Road No. 1, No. 3	Roads with a width of 4m or more that exist at the time of reference ※"Standard time" is November 23, 1950, when the law was enforced. ※It may be a public road or a private road. ※There are no survey maps in Yokohama City.

Road No. 1, No. 5	Roads built by landowners, etc., with a width of 4m or more that have been designated for their location Please confirm location designation drawing in i-Mappy or Housing and Architecture Bureau information consultation section (Yokohama Building Information Center on the second floor of City Hall).
Section 1 Road	Roads with a width of 4m or more, which are treated as roads under the Building Standards Law based on the materials of past building confirmation applications, etc.
Section 2 Roads	Roads with a width of less than 4m where buildings are lined up at the time of standard ※The width is treated as 4m because the line 2m from the center line of the road is regarded as the boundary line of the road. ※The site facing the section 2 road needs to retreat the gates within 2m from the center line of the road.
Road-shaped open space that requires certification and permission under Article 43, Paragraph 2 of the Act	Because it does not correspond to road of Building Standard Act, authorization application of law Article 43 Clause 2 first or permission application of second is necessary. 3 Consultation on roads based on the Building Standards Law

(1) Method of road survey

(2) Method of road consultation

4 Relationship between Sites and Roads (Article 43 of the Act)

The site of the building must be in contact with the road at least 2m. (Article 43, Paragraph 1 of the Act)
The term "road" here refers to the road prescribed in Article 42 of the Act.
In the case of a site in contact with the road in a dedicated passage (alleled part), or a site such as an apartment house or a large-scale building, please note that the approach conditions are added in the Yokohama City Building Standards Ordinance.
If the site of the building does not contact the road, or if the site of the building is in contact with the road, but the width of that part is less than 2m, it cannot be built in principle. Under certain conditions, such a site can be built only if it is approved as there is no obstacle to traffic, safety, fire prevention and hygiene. This is certification and permission under the provisions of Article 43, Paragraph 2 of the Building Standards Law. 5. Abolition of roads

What is the abolition of roads?
Roads based on the Building Standards Law shall, pursuant to Article 45 of the Act, if the site in contact with the road violates the road obligation under Article 43, Paragraph 1 of the Act due to changes or abolition of the road, or Paragraph 3 of the same Article If it violates the provisions of the ordinance based on the provisions of the above, it cannot be changed or abolished.

Procedure for Abolition
１．Request for prior examination of road abolition (change) (submission: Housing and Architecture Bureau Building Guidance Division City Hall 25th floor)

Abolition or change in order to examine in advance whether the surrounding buildings do not violate the rules of contact in Article 43 of the Act due to the abolition or change of the road, and to respond to the conditions for change or abolition, Prior to the application, it is necessary to submit a “Request for Road Abolition (Change) Preliminary Examination”.
In addition, if the road abolition (change) application (this application) is not made within six months from the date of receiving the examination (decision date), this pre-examination application will be invalidated and a new pre-examination application may be required.

※The contact point for prior consultation on the abolition and change of existing designated roads due to development activities and new construction of designated roads will be the Residential Land Examination Department.

２．Road abolition (change) application (this application)

When we change road by Building Standard Act or are going to abolish, it is necessary to submit application to the mayor based on 4 (change of road or the abolition) of Yokohama-shi building standard regulations Article 56.

※In the case of abolition (change) of No. 1 No. 5 road (position designated road), a fee of 30,000 yen will be charged.
(However, there is no fee for applying for the abolition (change) of the evacuation passage.) In the case of abolition (change) of the No. 1 No. 2 road, No. 1 No. 3 road, and No. 2 road, no fee will be charged .
