Please confirm about the handling of application about building tree planting with designated area expansion (planned) of tree planting area

  • In Yokohama, in order to expand the designated area of greening areas to commercial use areas.The city planning is scheduled to be changed in the first half of FY2024I'm doing it.
  • The greening area system is a system that requires greening above the standard when building or expanding a building over a certain site area, and is a building standard-related rule.
  • The legal greening rate is 5%.
  • If you fall under the following [Target], please complete the procedure without omission according to [Response Items].

[Target]

  Restricted Areas  :All or part of the site includes commercial restricted areas (excluding harbor areas)
  Site area  :500m2 or more
  Type of act :New construction and extension of buildings
  Construction start date: After the notification date of the city planning change pertaining to the expansion of the greening area (hereinafter referred to as the “notification date”)
         ※The notification date is scheduled for April 2024 or later.

(1) When a city plan for a greening area was established, "acts that have already begun" are excluded from the target.
  "The act that has been undertaken" is when it is deemed that there is an intention to continue the construction of the building, and the roots of the building (laying work) of the building.
   Including), pile driving, or construction of a part related to the increase in floor area of an existing building has been started.

(2) If the following 1.2 is started within six months from the day after the notification date, it will be regarded as "act started" and will be excluded from the target.
   1.Building of buildings with the consent of Article 17, Paragraph 1 of the Ordinance on Coordination of Yokohama City Development Project prior to the notification date
     (Including development activities performed for the purpose of providing the building for the construction of the building.)
   2.Building of buildings for which greening discussions have been established under the provisions of Article 9, Paragraph 1 of the Ordinance to Create and Raise Green Environment
   ※(2) The handling start date of 1 and 2 of the city planning change notification of greening area expansion.

  Before the completion inspection of the building confirmation, it is necessary to receive (or receive) a greening facility conformity certificate letter of advice based on the Urban Green Space Law.

It is necessary to receive (or receive) the grant of a greening facility conformity certification letter of advice based on the Urban Green Space Law before the completion inspection of the building confirmation. Please complete the procedures after the notification date.
※Once you have been issued a greening facility conformity certificate letter of advice, please receive the letter of advice again.

※The greening area system is a regulation related to building standards. If the procedure has not been completed or if the greening has not been completed according to the certification of the greening facility conformity certificate, an inspection certificate will not be issued.

Definitions and grounds

Article 35, Paragraph 1 (Excerpt) of Urban Green Space Law (Excerpt)
Article 35 In a greening area, new construction or extension of a building whose site area is larger than the size specified by a Cabinet Order (acts already undertaken when the city planning for the greening area was established and within the scope specified by a Cabinet Order Excludes extension. The same shall apply in this section below. ) Shall be the greening rate of the building concerned more than the minimum greening rate of the building specified in the city planning for greening areas. The same shall apply to persons who maintain and conservation the newly built or expanded building.

Standards (excerpt) for restrictions on greening rate of buildings in Yokohama Greening Area
Article 2, Paragraph 3 of the Urban Green Space Law, Article 35, Paragraph 1 of the Urban Green Space Act means that there is an intention to continue the construction of a building, and the root cutting of the building. (Including sheet pile work), or construction of a part related to the increase in the floor area of the existing building. Buildings that were being planned when the limit of the greening rate pertaining to the area was set, or confirmed by Article 6, Paragraph 1, Article 6-2, Paragraph 1, or Article 18 Paragraph 3 of the Building Standards Act This does not include new construction or extension of buildings that have not begun construction after receiving the certificate of completion.
