[Important Notice] For those planning construction in commercial restricted zones

Please confirm about the handling of application about building tree planting with designated area expansion of tree planting area

  • On May 24, 2024, the designated area for greening areas was expanded to commercial restricted areas.
  • The greening area system is a system that requires greening beyond the standard when building or expanding a building with a certain site area or more, and is a building standard-related rule.
  • The statutory greening rate is 5%.
  • If you fall under the following [target], please complete the procedure without omission as described in [Response Items].

[Target]

  Restricted areas  :All or part of the site includes commercial restricted areas (excluding harbor areas)
  Site area  :500m2 or more
  Type of act :New construction and extension of buildings
  Start date of construction: After the notification date of the city planning change pertaining to the expansion of the greening area (hereinafter referred to as the “notification date”)
         ※The announcement date is May 24, 2024.

(1) "Acts that have already been started" when city planning for greening areas is established are excluded from the target.
  "Activities that have been undertaken" refers to cases where it is deemed that there is an intention to continue the construction of the building, and the root cutting work of the building (Yaita hitting work).
   (Including), pile driving work, or construction of a part related to an increase in the floor area of existing buildings has been undertaken.

(2) If the following 1.2 is started within 6 months from the day after the notification date, it is considered as "the act that has been started" and is excluded from the target.
   1.Prior to the notification date, construction of buildings with the consent of Ordinance Article 17, Paragraph 1 on Coordination of Yokohama City Development Project, etc.
     (Including development activities performed for the purpose of providing for the construction of the building.)
   2.Prior to the notification date, construction of a building where a greening consultation was established under the provisions of Article 9, Paragraph 1 of the Ordinance to Create and Raise a Green Environment was established
   ※(2) The handling start date of 1 and 2 shall be from the date of notification of city planning change of greening area expansion.

[Response items]

  It is necessary to receive (or re-received) a greening facility conformity certificate letter of advice based on the Urban Green Space Law before the completion inspection of the building confirmation.
  Download the style from this web page and submit a greening rate conformity certificate (change) application. Please note that procedures should be requested after the date of notification.

It is necessary to receive (or re-receiate) the grant of a greening facility conformity certificate based on the Urban Green Space Law before the completion inspection of the building confirmation. Please complete the procedure after the notification date.
※Once, even if you have received a greening facility conformity certificate letter, please receive the letter again.

Receive a completion inspection of greening through the greening area system.
(Greening inspection is performed by the building supervisor or designated confirmation inspection organization.)
※The greening area system is a regulation related to building standards. If you have not completed the procedure or if the greening has not been completed according to the greening facility conformity certificate, you will not be issued an inspection certificate.

When a site including a commercial restricted zone and a residential restricted zone receives a notice of conformity with a greening facility in the greening area system and the start date is after the transition period.

※Those who have started during the transition period do not need to reapply.

Definition of Terms and Conditions

Article 35 In a greening area, new construction or extension of buildings whose site area is larger than the size specified by a Cabinet Order (acts that have already been undertaken when city planning for the greening area was established and within the range specified by a Cabinet Order Excludes extensions. The same shall apply hereinafter in this section. ) A person who intends to do so must make the greening rate of the building equal to or greater than the minimum greening rate of the building specified in the city planning for the greening area. The same shall apply to those who maintain the newly built or expanded buildings in conservation.

Article 2, Paragraph 3, Urban Green Space Law Article 35, Paragraph 1 "Act that has been undertaken" refers to the case where it is deemed that there is an intention to continue the construction of the building. (Including sheet pile driving work), pile driving work, or construction of a part related to an increase in the floor area of existing buildings has been started. Buildings that were under planning when the limit of the greening rate pertaining to the area was determined or confirmed by Article 6, Paragraph 1, Article 6-2, Paragraph 1 or Article 18, Paragraph 3 of the Building Standards Act It does not include new construction or extension of buildings that did not start construction after receiving the certificate of grant.
