Chapter 1 General Rules
(Objective)
Article 1 These regulations (hereinafter referred to as "these regulations") shall comply with the provisions of Article 22-2, Paragraph 2 of the Road Transport Act (Act No. 83 of 1951) to ensure the safety of transportation. The purpose is to determine the matters to be taken and to improve the safety of transportation.
(Applicable range)
Article 2 These Rules apply to business activities related to general (sharing and chartered) passenger car transport business and specified passenger car transport business operated by City of Yokohama, Transportation Bureau.
Chapter 2 Business Operation Policy, etc. to ensure the safety of transportation
(Basic Policy on Transport Safety)
Article 3 The Transport Business Manager shall deeply recognize that ensuring the safety of transportation is the basis of business management and play a leading role in ensuring the safety of transportation within the Bureau. In addition, thoroughly consider the situation at the site, such as listening to the voices of safety at the site, ensure that the safety of transportation is of the utmost importance for staff members.
2 The code of conduct related to the safety of transportation business managers and staff shall be as follows.
(1) Laws and related regulations concerning transportation safety (including these regulations) To understand and comply with this, and to perform duties strictly and faithfully.
(2) In carrying out duties, strive to enforce confirmation without relying on guesswork, and if there is any doubt, treat it as safest.
(3) In the event of an accident, disaster, etc., give priority to human life, promptly take safe and appropriate measures, and strive to minimize damage.
3. Ensure that plans for transportation safety are formulated, implemented, checked, and improved (Plan Do Check Act) and constantly reviewed safety measures, all staff will work together to constantly improve transportation safety. . In addition, we will actively disclose information on transportation safety.
(Priority Measures for Transport Safety)
Article 4 In accordance with the policy on transportation safety set forth in the preceding Article, the following matters shall be implemented:
(1) Ensure that the safety of transportation is of utmost importance, and comply with relevant laws and regulations and the matters set forth in these Regulations.
(2) Efforts shall be made to actively and efficiently carry out expenses and investments related to transportation safety.
(3) Conduct internal audits on transportation safety and take necessary corrective or preventive measures.
(4) Establish a communication system for information related to transportation safety and communicate and share necessary information within the Department.
(5) Develop and implement concrete plans for education and training on transportation safety.
(Goals for Transport Safety)
Article 5 Establish goals based on the policies set forth in Article 3.
(Plan for Transport Safety)
Article 6 Achieve the goals set forth in the preceding Article and create plans necessary to ensure the safety of transportation in accordance with priority measures related to transportation safety.
Chapter 3 Implementation of business to ensure the safety of transportation and its management system
(Responsibilities of Transportation Business Managers)
Article 7 The transportation business manager shall have the ultimate responsibility for ensuring the safety of transportation.
2. The transportation business manager shall take necessary measures, such as securing a budget and establishing a system, in order to ensure transportation safety.
3. The Transportation Business Manager shall respect the opinions of the Safety Management Manager regarding ensuring the safety of transportation.
4. The transportation business manager shall always check whether the status of the implementation and management of the work to ensure the safety of transportation is appropriate and make necessary improvements.
(Organizational structure)
Article 8 Based on the following persons, establish a responsible system for ensuring the safety of transportation and appropriately implement corporate governance to ensure the safety of transportation.
(1) General Manager of Safety Management
(2) Safety Management Assistant (Transportation Manager)
(3) Safety Manager (Operation Manager)
(4) General Operation Manager (Deputy Director)
(5) Operation manager (assistant)
(6) Maintenance Manager (Vehicle Maintenance Manager)
(7) Other necessary persons
2 The Safety Management Assistant (Transportation Manager) assists the duties of the Safety Management Manager and supervises and supervises sales offices regarding ensuring transportation safety.
3 The safety manager (business manager) receives the order of the safety manager and the safety management assistant, and supervises and supervises the staff members together with the general operation manager to ensure the safety of transportation.
4 Regarding the organizational structure and command system related to transportation safety, refer to the Safety Management System diagram (see Figure 1), including when the Safety Management Manager is absent due to illness, etc., or when dealing with serious accidents or disasters.
(Appointment and dismissal of the Safety Management Manager)
Article 9 The Safety Supervisor shall be the Passenger Vehicle Transport Business Transportation Regulations (Ministry of Transport Ordinance No. 44 of 1956). Hereinafter referred to as "Transportation Rules". ) Appointed from among persons who meet the requirements stipulated in Article 47-5 and who have sufficient knowledge and experience regarding safety.
(2) If the Safety Supervisor falls under any of the following items, the Manager shall be dismissed.
(1) When an order for dismissal of the Minister of Land, Infrastructure, Transport and Tourism is issued.
(2) When it becomes difficult to continue performing duties due to physical breakdown or other unavoidable reasons.
(3) When it is deemed that continuing to perform its duties by the Safety Supervisor may hinder the safety of transportation due to violations of relevant laws and regulations or neglect to confirm the status of ensuring transportation safety.
(Responsibilities of the Safety Management Manager)
Article 10 The Safety Supervisor shall have the following responsibilities:
(1) Ensure that all staff members are aware that it is most important to comply with relevant laws and regulations and ensure transportation safety.
(2) Establish and maintain a system of implementation and management for ensuring the safety of transportation.
(3) Implement policies, priority measures, targets and plans related to transportation safety in good faith.
(4) Establish a reporting and communication system on transportation safety and make it known to staff.
(5) Conduct internal audits on the status of ensuring transportation safety periodically and as necessary, and report to the transportation business manager.
(6) Take necessary measures for improvement, such as giving opinions on necessary improvements to ensure the safety of transportation to transportation business managers.
(7) Supervision and management of the operation manager so that operation management is performed properly.
(8) Provide necessary education or training to staff to ensure transportation safety.
(9) Conduct comprehensive management to ensure the safety of other transportation.
Chapter 4 Implementation and management of projects to ensure the safety of transportation
(Implementation of priority measures related to transportation safety)
Article 11 Based on the Basic Policy on Transport Safety, in order to achieve the goals related to transport safety, steadily implement priority measures related to transport safety in accordance with the plan on transport safety.
(Sharing and communicating information on transportation safety)
Article 12 Through sufficient two-way communication between the transportation business manager and the site, operation manager and the driver, etc., information on transportation safety is transmitted and shared within the bureau in a timely and appropriate manner. Strive. In addition, if a situation that impairs safety is found, do not overlook or conceal, immediately inform the relevant parties and take appropriate measures.
(Report and Communication System for Accidents, Disasters, etc.)
Article 13 In the event of an accident or disaster, the reporting and communication system for such accidents, disasters, etc. shall be based on the reporting and communication system in the event of an accident or disaster (see Figure 2).
2. Efforts shall be made to promptly transmit reports on accidents, disasters, etc. to the safety general manager, transportation business manager, or necessary sections within the bureau.
3. The Safety Management Manager shall disseminate the reporting and communication system within the Bureau and provide necessary instructions to ensure that the reporting and communication system set forth in paragraph 1 is fully functioning and that the response after an accident, disaster, etc. proceed smoothly.
4 In the event of an accident, disaster, etc. specified in the Automobile Accident Reporting Regulations (Ministry of Transport Ordinance No. 104 of 1951), the necessary report or notification shall be made to the Minister of Land, Infrastructure, Transport and Tourism based on the rules of the Reporting Regulations.
(Education and training on transportation safety)
Article 14 In order to achieve the transport safety goals set forth in Article 5, formulate and steadily implement specific plans for education and training for the necessary human resource development.
(Internal audit on transport safety)
Article 15 In order to realize the measures of the Safety Management Manager, the Internal Audit Committee shall be established as an organization that confirms the methods of carrying out and managing transportation operations and promotes measures to improve safety, such as measures to prevent recurrence of accidents.
2 The Internal Audit Committee, chaired by the General Manager of the Safety Management Department, formulates specific details of the audits in order to check the implementation status of safety management, etc., and conducts internal audits on transportation safety at least once a year by the Internal Audit Committee members appointed by the Internal Audit Committee.
3 In the event of a serious accident, disaster, etc., or when a similar accident, disaster, etc. occurs repeatedly, and if the transportation business manager or the safety management manager deems it necessary, internal audit on transportation safety shall be conducted temporarily.
(4) The Safety Management Manager shall promptly report the results of the internal audit prescribed in the preceding two paragraphs to the Transportation Business Manager if any matters to be improved are found, promptly report the contents to the Transportation Business Manager, examine the necessary measures to ensure the safety of transportation and take necessary corrective measures or preventive measures as necessary for the time being.
(Organization related to the promotion of measures to prevent accidents, disasters, etc.)
Article 16 The Automotive Headquarters Safety Management Committee shall be established as an organization that assists the work of the Safety Management Manager and formulates specific plans for the implementation and management of transport operations.
2 The Safety Management Committee of the Automobile Headquarters shall be composed of persons in the positions listed in the Safety Management System Map (see Figure 1) and shall be supervised by the Safety Management Manager.
3. The Automobile Headquarters Safety Management Committee shall set up a secretariat in the Transportation Division and discuss, formulate and implement specific plans for the following matters.
(1) Matters related to annual safety targets and annual plans.
(2) Analysis of driving accidents and disaster accidents and precautionary measures.
(3) Matters related to the implementation of internal audits.
(4) Matters related to improvement measures based on audit results.
(5) Matters concerning the reform of staff awareness and the contents of education and training.
(6) Matters related to information disclosure.
(Improvement of operations related to transportation safety)
Article 17 If the Safety Supervisor reports on accidents, disasters, etc., or reports on the results of internal audits under Article 15 or matters to be improved, or if it is deemed necessary to ensure the safety of transportation, consider measures for improvement necessary to ensure the safety of transportation and take corrective measures or preventive measures.
2 In the event of a serious accident due to a malicious violation of laws and regulations, take measures to ensure even higher safety in all safety measures or necessary matters.
(Disclosure of information)
Article 18 Basic policies on transport safety, transportation safety targets and status of achievement of these targets, statistics on accidents stipulated in Article 2 of the Automobile Accident Reporting Regulations, organizational structure and command system for transport safety, transportation safety, transportation safety plans, actual amount of transportation safety budgets, reporting and communication systems for accidents, disasters, etc., safety management regulations, safety management regulations, and transportation safety audit results.
2. If a report is made to the Ministry of Land, Infrastructure, Transport and Tourism regarding the status of improvements taken to ensure the safety of transportation pursuant to Article 47-7 of the Transport Regulations, it shall be promptly made public to the outside.
(Management of records related to transportation safety, etc.)
Article 19 These Regulations shall be reviewed periodically and in a timely and appropriate manner in accordance with the actual conditions of business.
2 Record the minutes of the meeting, the reporting communication system, reports on accidents, disasters, etc., instructions of the safety supervisor, internal audits, corrective measures or preventive measures reported to the transportation business manager in preparation of the business operation policy on transportation safety, and record them appropriately.
(3) The method of recording and storing the information set forth in the preceding paragraph and other information related to the safety of transportation shall be specified separately.
(Collaboration system for transport safety)
Article 20 In the outsourcing of management, the trustee and the contractor shall cooperate and cooperate with each other to improve the safety of transportation.
