In order to make the provision of information on health hazards caused by functionally labeled foods and foods for specified health use (functionally labeled foods, etc.) more effective, the Food Sanitation Law Enforcement Regulations were revised on August 23, 2024, The information provision system for health hazards caused by functionally labeled foods started on September 1, 2024.

Functionally labeled foods (notification system)

By submitting information on the grounds for safety and functionality to the Commissioner of the Consumer Affairs Agency before selling, it is possible to display the effect of maintaining and improving health at the responsibility of the business operator.
Unlike foods for specified health use, the government does not review safety and functionality, and the reported information is published on the Consumer Affairs Agency website.

Foods for specified health use (individual permission system)

Foods that have been recognized based on scientific evidence to help maintain and improve health, and that labels such as "reducing cholesterol absorption" are permitted.
The effects and safety displayed are reviewed by the government, and each food is approved by the Commissioner of the Consumer Affairs Agency.

Overview of information provision system for health hazards caused by functionally labeled foods, etc.

The person who submits the functionally labeled food and the person who has been licensed for the specified health food shall be subject to the health hazards caused by the functionally labeled food, etc. (Received a doctor's diagnosis, and if the symptoms are caused or suspected of the food or additive. ), And if information is obtained that there is a risk of occurrence or spread of health damage, the information must be promptly provided to the prefectural governors.

Persons who are obliged to provide information on health damage information (notifiers, etc.)

  • Notifier prescribed in Article 2, Paragraph 1, Item 10 b of the Food Labeling Standards (notifier of functionally labeled food)
  • Persons who have obtained permission under Article 43, Paragraph 1 of the Health Promotion Act pertaining to foods for specified health use (persons who have received permission for foods for specified health use)

Cases in which a duty to provide health damage information

Cases in which multiple cases of the same finding occurred in a short period of time among health hazards caused by the same functionally labeled foods

  • The "case of the same finding" is theInformation Provision Form (Excel: 380KB)This refers to the case where the "main symptoms" are the same.
  • "Multiple outbreaks in a short period of time" refers to cases where two cases of the same finding occur within approximately 30 days.

However, for the following cases, it is necessary to provide information even for one case.

  • Cases of death
  • Serious cases such as cases where inpatient treatment is judged to be serious by the doctor, cases where the doctor determines to be serious even if not inpatient treatment is not received.

Cases not covered by information provision

Cases in which a causal relationship with the intake of functionally labeled foods is clearly denied

  • Obviously, if the product is not ingested or if it is considered unrelated to the symptoms caused by the product based on the timing of intake and the timing of the symptoms.
  • When a doctor diagnoses the causal relationship with the intake of the functionally labeled food, etc.

However, cases where the causal relationship is unknown are included in the information provision target.

Method of Information Provision

Notifiers enter and submit the information heard from the information provider and doctors in "(1) Style used by businesses in interviews with information providers" in the information provision slip (Excel: 380KB). . If necessary, you can submit reference materials and additional information attached.
