Notification procedures based on the National Land Use Planning Act

[Important Notice] Due to the start of receiving online notifications from January 2023, the acceptance of notifications by mail has been discontinued on April 17, 2023. In addition, from November 2023, "Land Trading, etc. registration form (Excel)" has added an input support function.

Outline of the System

When a land purchase contract is concluded for land that exceeds the standard area stipulated by law, the right acquirer (transferee) must submit the registration form to the head of the prefecture or designated city within two weeks (including the date of the contract).

Standard area (in the case of Yokohama city)

  • Urbanization area: 2,000 square meters or more
  • Urbanization adjustment area: 5,000 square meters or more
  • If either the public book or the actual measurement is equal to or greater than the above area, a notification is required.
  • When acquiring multiple adjacent lands, if a group of land (land that can be used together is acquired by the same entity based on a series of business plans), even if the area of each contract is small , Notification is required if the total area used exceeds the above area. In this case, one notification is required for each contract.

Type of rights

  • Ownership
  • Lease rights (including payment of rights and other lump-sum payments)
  • Ground rights
  • Beneficiary rights in trust (if the contract includes the right to transfer ownership of the land)
  • Transfer of status, etc.

Method of Transfer of Rights

  1. (including economic value that can be converted into monetary);
  2. The contract is based on "contract"

<Example> Sale, bidding, disposal of reserved land (land readjustment), exchange, business transfer, collateral, repayment of goods, transfer of co-ownership, transfer of reservation completion right, transfer of repurchase right, transfer of trust beneficiary right, transfer of status

  • Notification is also required for contracts with reservation / suspension (cancellation) conditions for these transactions.

When notification is not required

  • National and local governments and Port Affairs Bureau, Urban Renaissance Agency, Water Resources Agency, Japan Water Resources Agency, Small and Medium Enterprise Infrastructure Development Organization, Railway Construction and Transport Facility Development Support Organization, Local Housing Supply Corporation, Contractors with the Japan Workers' Housing Association, the Airport Surrounding Maintenance Organization, Local Road Corporation and Land Development Corporation
  • Setting of mortgages, transfer or setting of land titles and use leases (notification of mortgage direct current contracts (contracts for mortgages to acquire ownership during repayment period), etc.)
  • Gifts, division of heritage, etc. (without payment of consideration)
  • Exercise of Formation Rights (not based on contract)
  • Inheritance, comprehensive succession due to merger of corporations, land replacement such as land readjustment, exercise of repurchase rights, etc. (Notification is required when transferring the repurchase right to a third party or disposal of reserved land readjustment, etc.)
  • Procedures based on the Bankruptcy Law, Corporate Rehabilitation Act, Civil Rehabilitation Act, etc. that are carried out with the permission of the court (if the court permit does not specify individual land, a notification is required)

  • seal to registration form is not required for submissions after January 4, 2021.
  • For online application, please upload "Excel File" and "attached documents PDF file".
  • Because the format differs for each municipality, please use the registration form prescribed by Motoichi.

  • Copy of contract
  • Location map and guide map
  • Copy of official map
  • Land use plan drawings (eg, planning drawings for detached houses, layout drawings and floor plans of apartment houses, etc.)
  • Copy of actual measurement map (attached when a sales contract is concluded with actual measurement area)

※Please indicate the range of the reported land with markers etc. in drawings.

Please submit the above presentation documents by Yokohama-shi electronic application, report system or bringing.

Please enter required items from Yokohama City Electronic Application and Notification System (outside site) and attach the above presentation documents.

  • registration form "Excel file" and "attached documents PDF file" in one folder, compress it in zip format, and upload it.
  • No duplicate copies of registration form will be issued for notification under this system.
  • If you wish to have a duplicate, please submit a report by bringing it.

You can check the status of the procedure from "My Page", and we will send you a notification email when the procedure is completed.
