Outline of asbestos regulations under the Building Standards Law

Restrict the use of asbestos in buildings to prevent health damage caused by asbestos.

Background

  • Items that may cause asbestos to be scattered, such as sprayed asbestos, may cause health hazards to building users.
  • For this reason, in the future, regulations on the use of asbestos in buildings will be introduced so as not to cause health hazards caused by asbestos scattering.

Outline of Law Revision

Regulatory the use of building materials that may cause asbestos to be scattered.
※ Specifically, sprayed asbestos and sprayed rock wool containing asbestos (weight weighing more than 0.1%) are subject to regulation.

Outline of revision of Cabinet Order

  1. Determine asbestos as a substance that is extremely harmful to hygiene by scattering.

At the time of extension and remodeling, asbestos removal is required in principle, but for extension and remodeling where the floor area of the extension / remodeling part does not exceed 1/2 of the floor area before extension / remodeling, containment and enclosure measures other than the extension and remodeling part. Outline of amendments to ministerial ordinances and notifications

Revision of the Building Standards Law Enforcement Regulations

  • At the time of extension / remodeling, large-scale repairs / remodeling, specify the location of the measures, etc. in the floor plan of each floor of the building confirmation application.
  • Describe the presence or absence of sprayed asbestos, etc. and whether measures are planned in the periodic survey report. (Effected on April 1, 2007)

Notification (2006 Notification No. 1172) that determines building materials that have been added in advance with asbestos, etc., which is not likely to scatter or emit asbestos.

  • Building materials that add asbestos other than sprayed asbestos and asbestos-containing sprayed rock wool should be determined in advance as building materials that add asbestos, etc., which is not likely to scatter or disperse asbestos.

Notification stipulating standards for containment and enclosure measures (2006 Notification No. 1173)
(1) Standards for Containment Measures

  • Cover building materials with asbestos added, or adhere the added asbestos to building materials. .
  • If the building material to which asbestos has been added is significantly deteriorated or damaged, take measures to prevent asbestos from scattering from the relevant part.

(2) Standards for enclosure measures

  • Enclose building materials with asbestos with materials that do not transmit asbestos, such as boards.
  • Take measures to prevent asbestos from scattering from the part when there is significant deterioration or damage to the building material to which asbestos has been added.

Notification of Partial Revision of 2000 Notification No. 1446 (2006 Notification No. 1168)

  • Add preventive agents used for containment measures to the subject of certification under Article 37, Paragraph 2 of the Building Standards Act.
  • The following contents shall be defined as technical standards for the quality of preventive agents.
  • (1) The following content shall be defined as technical standards for the following quality:
